11 Technology; providing for membership; providing
12 for a report; providing duties; providing for
13 funding; providing for repeal; providing an
14 effective date.

16 Be It Enacted by the Legislature of the State of Florida:
17
18 Section 1. Subsections (5) and (6) of section 322.142,
19 Florida Statutes, 1998 Supplement, are repealed.
20 Section 2. Subsection (8) is added to section
21 282.3091, Florida Statutes, 1998 Supplement, to read:
22 282.3091 State Technology Council; creation.--
23 (8) The council shall create a Task Force on Privacy
24 and Technology. The task force shall include professionals in
25 the fields of communications, government, law enforcement,
26 law, marketing, technology, and financial services, including,
27 but not limited to, the Society of Consumer Affairs
28 Professionals in Business, the Florida Retail Federation, and
29 the Office of Statewide Prosecution. The task force shall
30 study and make recommendations by February 1, 2000, in a
31 report to the Legislature and the Governor regarding:

1 (a) Privacy issues under the Constitutions and laws of
2 the United States and the State of Florida, the Public Records
3 Act, and the advent of the use of advanced technologies.
4 (b) Technology fraud, including, but not limited to,
5 the illegal use of citizens' identities and credit.
6 (c) Balancing the traditional openness of public
7 records in the state with the need to protect the privacy and
8 identity of individuals.
9 (d) The sale of public records to private individuals
10 and companies.

12 In order to carry out its duties and responsibilities, the
13 task force shall hold a summit to gather the best available
14 knowledge regarding these issues. The council shall staff the
15 task force as necessary. The members of the task force shall
16 serve without compensation, but shall be reimbursed for
17 reasonable and necessary expenses of attending the summit and
18 performing duties of the task force, including per diem and
19 travel expenses as provided in s. 112.061. Such expenses shall
20 be reimbursed from funds of the Department of Highway Safety
21 and Motor Vehicles. This subsection is repealed July 1, 2000.
22 Section 3. This act shall take effect upon becoming a
23 law.
