1 A bill to be entitled
2 An act relating to weapons and firearms;
3 amending s. 790.06, F.S.; exempting certain
4 retired law enforcement officers from the fees
5 imposed by the Department of State for a
6 license to carry a concealed weapon or firearm;
7 providing an effective date.

9 Be It Enacted by the Legislature of the State of Florida:

11 Section 1. Paragraph (b) of subsection (5) of section
12 790.06, Florida Statutes, 1998 Supplement, is amended to read:
13 790.06 License to carry concealed weapon or firearm.--
14 (5) The applicant shall submit to the Department of
15 State:
16 (b) A nonrefundable license fee not to exceed $85, if
17 he or she has not previously been issued a statewide license,
18 or a nonrefundable license fee not to exceed $70 for renewal
19 of a statewide license. Costs for processing the set of
20 fingerprints as required in paragraph (c) shall be borne by
21 the applicant. However, an individual holding an active
22 certification from the Criminal Justice Standards and Training
23 Commission as a "law enforcement officer," "correctional
24 officer," or "correctional probation officer" as defined in s.
25 943.10(1), (2), (3), (6), (7), (8), or (9) is exempt from the
26 licensing requirements of this section. If any individual
27 holding an active certification from the Criminal Justice
28 Standards and Training Commission as a "law enforcement
29 officer," a "correctional officer," or a "correctional
30 probation officer" as defined in s. 943.10(1), (2), (3), (6),
31 (7), (8), or (9) wishes to receive a concealed weapons or

1 firearms license, such person is exempt from the background
2 investigation and all background investigation fees, but shall
3 pay the current license fees regularly required to be paid by
4 nonexempt applicants. Further, a law enforcement officer, a
5 correctional officer, or a correctional probation officer as
6 defined in s. 943.10(1), (2), or (3) is exempt from the
7 required fees and background investigation for a period of 1
8 year subsequent to the date of retirement of said officer as a
9 law enforcement officer, a correctional officer, or a
10 correctional probation officer. A person who is retired from
11 at least 20 years of service in this state or any other state
12 as a law enforcement officer, as defined in s. 943.10(1), is
13 exempt from the license fee and the license renewal fee.
14 Section 2. This act shall take effect July 1, 1999.

Provides that a person who is retired following at least
19 20 years of service as a law enforcement officer in this
state or any other state is exempt from paying the fees
20 for a license to carry a concealed weapon or firearm.
