1 A bill to be entitled
2 An act relating to weapons and firearms;
3 amending s. 790.06, F.S.; exempting certain
4 retired law enforcement, correctional, or
5 correctional probation officers from the fees
6 imposed by the Department of State for a
7 license to carry a concealed weapon or firearm;
8 providing an effective date.

10 Be It Enacted by the Legislature of the State of Florida:
11
12 Section 1. Paragraph (b) of subsection (5) of section
13 790.06, Florida Statutes, 1998 Supplement, is amended to read:
14 790.06 License to carry concealed weapon or firearm.--
15 (5) The applicant shall submit to the Department of
16 State:
17 (b) A nonrefundable license fee not to exceed $85, if
18 he or she has not previously been issued a statewide license,
19 or a nonrefundable license fee not to exceed $70 for renewal
20 of a statewide license. Costs for processing the set of
21 fingerprints as required in paragraph (c) shall be borne by
22 the applicant. However, an individual holding an active
23 certification from the Criminal Justice Standards and Training
24 Commission as a "law enforcement officer," "correctional
25 officer," or "correctional probation officer" as defined in s.
26 943.10(1), (2), (3), (6), (7), (8), or (9) is exempt from the
27 licensing requirements of this section. If any individual
28 holding an active certification from the Criminal Justice
29 Standards and Training Commission as a "law enforcement
30 officer," a "correctional officer," or a "correctional
31 probation officer" as defined in s. 943.10(1), (2), (3), (6),

1 (7), (8), or (9) wishes to receive a concealed weapons or
2 firearms license, such person is exempt from the background
3 investigation and all background investigation fees, but shall
4 pay the current license fees regularly required to be paid by
5 nonexempt applicants. Further, a law enforcement officer, a
6 correctional officer, or a correctional probation officer as
7 defined in s. 943.10(1), (2), or (3) is exempt from the
8 required fees and background investigation for a period of 1
9 year subsequent to the date of retirement of said officer as a
10 law enforcement officer, a correctional officer, or a
11 correctional probation officer. A person who is retired from
12 at least 20 years of service in this state as a law
13 enforcement officer, a correctional officer, or a correctional
14 probation officer as defined in s. 943.10(1), (2), or (3) is
15 exempt from the license fee and the license renewal fee.
16 Section 2. This act shall take effect July 1, 1999.

18 STATEMENT OF SUBSTANTIAL CHANGES CONTAINED IN
COMMITTEE SUBSTITUTE FOR
19 SB 1028

21 The committee substitute provides that Florida retired
correctional and correctional probation officers, as well as
22 law enforcement officers, are exempt from concealed weapon
license fees. The exemption for out-of-state law enforcement
23 officers has been removed from the bill.
