  1                      A bill to be entitled

  2         An act relating to commerce; providing

  3         procedures for freight forwarders that obtain

  4         transportation for tangible personal property

  5         for a business in this state; providing an

  6         effective date.

  8  Be It Enacted by the Legislature of the State of Florida:

  9

10         Section 1.  A business operating in this state as a

11  freight forwarder which receives tangible personal property

12  from a person for the purpose of transporting such property by

13  air or water shall provide the person a warehouse receipt at

14  the time the property is delivered to the freight forwarder's

15  place of business. The warehouse receipt must contain the

16  name, address, and telephone number of the freight forwarder;

17  a pre-printed warehouse receipt number; the date the property

18  was delivered to the freight forwarder; and a brief

19  description of the property. Within 2 weeks after the date the

20  freight forwarder receives the airway bill or bill of lading

21  from the transportation company with whom the freight

22  forwarder has contracted to transport the property, the

23  freight forwarder must mail such airway bill or bill of lading

24  to the person who hired the freight forwarder to provide

25  transportation for the property. The purpose of this section

26  is to provide a person who wishes to transport tangible

27  personal property pursuant to section 12A-1.064(1)(b)2. of the

28  Florida Administrative Code with sufficient proof to exempt

29  the property from the state sales tax.

30         Section 2.  This act shall take effect July 1, 1999.
