1 A bill to be entitled
2 An act relating to pharmacy practice; creating
3 s. 465.0075, F.S.; authorizing licensure of
4 pharmacists by endorsement and providing
5 requirements therefor, including a fee;
6 providing an effective date.

8 Be It Enacted by the Legislature of the State of Florida:
9
10 Section 1. Section 465.0075, Florida Statutes, is
11 created to read:
12 465.0075 Licensure by endorsement; requirements;
13 fee.--
14 (1) The department shall issue a license by
15 endorsement to any applicant who, upon applying to the
16 department and remitting a nonrefundable fee not to exceed
17 $100 set by the board, the board certifies:
18 (a) Has met the qualifications for licensure in s.
19 465.007(1)(b)-(c);
20 (b) Has obtained a passing score, as established by
21 rule of the board, on the licensure examination of the
22 National Association of Boards of Pharmacy (NABPLEX) or a
23 similar national organization, provided the board certifies as
24 eligible for licensure by endorsement any applicant who took
25 the required examination not more than 15 years prior to
26 application;
27 (c)1. Has submitted evidence of the active licensed
28 practice of pharmacy in another jurisdiction for at least 2 of
29 the immediately preceding 5 years or evidence of successful
30 completion of either board-approved postgraduate training or a
31 board-approved clinical competency examination within the year

1 preceding the filing of an application for licensure. For
2 purposes of this paragraph, "active licensed practice of
3 pharmacy" means that practice of pharmacy by pharmacists,
4 including those employed by any governmental entity in
5 community or public health, as defined by this chapter; or
6 2. Has completed an internship meeting the
7 requirements of s. 465.007(1)(c) within the two years
8 immediately preceding application; and
9 (d) Has obtained a passing score on the pharmacy
10 jurisprudence portions of the licensure examination as
11 required by board rule.
12 (2) Upon certification by the board, the department
13 shall impose conditions, limitations, or restrictions on a
14 license by endorsement if the applicant is on probation in
15 another jurisdiction for an act that would constitute a
16 violation of this chapter.
17 (3) The department shall not issue a license by
18 endorsement to any applicant who is under investigation in any
19 jurisdiction for an act or offense that would constitute a
20 violation of this chapter until such time as the investigation
21 is complete, at which time the provisions of s. 465.016 shall
22 apply.
23 (4) The department shall not issue a license by
24 endorsement to any applicant whose license to practice
25 pharmacy has been suspended or revoked in another state or to
26 any applicant who is currently the subject of any disciplinary
27 proceeding in another state.
28 Section 2. This act shall take effect upon becoming a
29 law.
