1 A bill to be entitled
2 An act relating to campaign financing; amending
3 s. 106.05, F.S.; requiring candidates to
4 endorse checks to be deposited into a campaign
5 depository; creating s. 106.051, F.S.;
6 providing a limitation on solicitation and
7 acceptance of campaign contributions by
8 legislators; providing an effective date.

10 Be It Enacted by the Legislature of the State of Florida:

12 Section 1. Section 106.05, Florida Statutes, is
13 amended to read:
14 106.05 Deposit of contributions; statement of campaign
15 treasurer.--All funds received by the campaign treasurer of
16 any candidate or political committee shall, prior to the end
17 of the 5th business day following the receipt thereof,
18 Saturdays, Sundays, and legal holidays excluded, be deposited
19 in a campaign depository designated pursuant to s. 106.021, in
20 an account designated "...(name of candidate or committee)...
21 Campaign Account." Except for cashiers' checks, all checks
22 received by the campaign treasurer must be endorsed personally
23 by the candidate before being deposited in a campaign
24 depository. Except for contributions to political committees
25 made by payroll deduction, all deposits shall be accompanied
26 by a bank deposit slip containing the name of each contributor
27 and the amount contributed by each. If a contribution is
28 deposited in a secondary campaign depository, the depository
29 shall forward the full amount of the deposit, along with a
30 copy of the deposit slip accompanying the deposit, to the

1 primary campaign depository prior to the end of the 1st
2 business day following the deposit.
3 Section 2. Section 106.051, Florida Statutes, is
4 created to read:
5 106.051 Solicitation of campaign contributions;
6 limitation.--A member of the State Legislature shall not
7 solicit or accept any campaign contribution on behalf of any
8 legislator, a political party, or any candidate for the
9 Legislature 30 days prior to a regular or special legislative
10 session, during a regular or special legislative session, or
11 14 days following a regular or special legislative session.
12 Section 3. This act shall take effect July 1, 1999.

15 SENATE SUMMARY
16 Provides that all checks, except cashiers' checks, which
are received by the campaign treasurer must be endorsed
17 by the candidate prior to being deposited in a campaign
depository. Prohibits a legislator from soliciting or
18 accepting campaign contributions on behalf of a
legislator, political party, or legislative candidate 30
19 days prior to a regular or special session of the
Legislature, during a regular or special legislative
20 session, or 14 days following a regular or special
legislative session.
