1 A bill to be entitled
2 An act relating to Department of Education pool
3 purchase program; amending s. 229.79, F.S.;
4 revising the pool purchase program to include
5 services, to permit suppliers to make
6 commodities and services available to other
7 governmental agencies and nonprofit
8 organizations under certain contracts, and to
9 permit multiple suppliers under certain
10 circumstances; providing an effective date.

12 Be It Enacted by the Legislature of the State of Florida:

14 Section 1. Section 229.79, Florida Statutes, is
15 amended to read:
16 229.79 Special services of the department; pooling of
17 purchases by school boards.--The Department of Education shall
18 render such special services as will be of benefit to the
19 schools of the state. As one phase of these services it shall
20 assist school boards in securing school buses, services,
21 contractual needs, equipment, and supplies at as reasonable
22 prices as possible by providing a plan under which school
23 boards may voluntarily pool their bids for such purchases. The
24 Department of Education shall prepare bid forms and
25 specifications, obtain quotations of prices and make such
26 information available to school boards in order to facilitate
27 this service. School boards from time to time, as prescribed
28 by the state board, shall furnish the Department of Education
29 with information concerning the prices paid for such items and
30 the Department of Education shall furnish to school boards
31 periodic information concerning the lowest prices at which

1 school buses, services, equipment, and school supplies are
2 available based upon comparable specifications. Suppliers may
3 make such commodities and services available to other
4 governmental agencies and nonprofit organizations under
5 contracts approved by the Department of Education. If the
6 Department of Education determines that it is in the best
7 interest of the school boards, contracts awarded under this
8 section may be awarded to multiple suppliers.
9 Section 2. This act shall take effect July 1, 1999.

to include the purchase of services, to authorize
15 suppliers to make commodities and services available to
other governmental agencies and nonprofit organizations
16 under contracts approved by the department, and to permit
contract awards to multiple suppliers under described
