1 A bill to be entitled
2 An act relating to traumatic brain injury;
3 creating s. 402.09, F.S.; requiring the
4 Department of Children and Family Services to
5 provide community-based services, in certain
6 circumstances, to individuals who have
7 sustained traumatic brain injury; providing for
8 rules; providing an effective date.

10 Be It Enacted by the Legislature of the State of Florida:

12 Section 1. Section 402.09, Florida Statutes, is
13 created to read:
14 402.09 Traumatic brain injury.--
15 (1) The Department of Children and Family Services
16 shall, contingent upon specific appropriations, establish a
17 program of long-term community-based supports and services for
18 individuals who have sustained traumatic brain injuries and
19 whose needs cannot be met through other programs related to
20 brain injury which are located within the Department of
21 Health, the Department of Labor and Employment Security, or
22 the Department of Children and Family Services, or whose needs
23 cannot be met through any other programs for which they may be
24 eligible. The determination-of-eligibility process for this
25 program must include a process for ensuring that the
26 individual is ineligible for other programs or has needs that
27 cannot be met through other programs of the department or
28 other agencies for which he or she is eligible. This program
29 is to be the program of last resort for individuals who have
30 sustained traumatic brain injuries. Supports and services may
31 be purchased by department staff. This program is intended to

1 prevent inappropriate residential and institutional placements
2 and must be designed to enhance or maximize the individual's
3 independence.
4 (2) The Department of Children and Family Services
5 shall adopt rules for implementing and administering the
6 program and shall establish the eligibility criteria for
7 individuals who apply for and receive services from the
8 program.
9 Section 2. This act shall take effect upon becoming a
10 law.
