14 On page 13, line 29, through page 14, line 26,
15 remove from the bill: all of said lines

17 and insert in lieu thereof:
18 criminal offenders who meet the criteria in s. 775.087(2) and
19 (3), Florida Statutes, be sentenced to the minimum mandatory
20 prison terms provided herein. For every case in which the
21 offender meets the criteria in this act and does not receive
22 the mandatory minimum prison sentence, the state attorney must
23 explain the sentencing deviation in writing and place such
24 explanation in the case file maintained by the state attorney.
25 On a quarterly basis, each state attorney shall submit copies
26 of deviation memoranda regarding offenses committed on or
27 after the effective date of this act to the President of the
28 Florida Prosecuting Attorneys Association, Inc. The
29 association must maintain such information and make such
30 information available to the public upon request for at least
31 a 10-year period.

1 (2) Effective July 1, 2000, each state attorney shall
2 annually report to the Speaker of the House, the President of
3 the Senate, and the Executive Office of the Governor regarding
4 the prosecution and sentencing of offenders who met the
5 criteria in s. 775.087(2)(a)3. and (3)(a)3., Florida Statutes.
6 The report shall include the number of charges received in
7 each circuit during the previous fiscal year by law
8 enforcement agencies which based a criminal charge on facts
9 demonstrating that the defendant met the criteria in s.
10 775.087(2)(a)3. and (3)(a)3., Florida Statutes, the case
11 number of the state attorney's office involving such criminal
12 charges, the final disposition, if any, of such cases, whether
13 the minimum mandatory prison terms authorized herein were
14 imposed in such cases, and a copy of each deviation memorandum
15 that state a written
