13         Amendment (with title amendment) 

14         On page 8, line 19,

16  insert after "(b)":  No contract, court order or settlement

17  agreement shall authorize or permit the payment, negotiation

18  or collection by private counsel of any attorney's fee for

19  work performed on behalf of the state or any agency thereof in

20  excess of an amount calculated in accordance with the lodestar

21  process approved by the Florida Supreme Court, which

22  attorney's fee shall be set by the determination of the number

23  of hours reasonably expended on the matter and the reasonable

24  hourly rate for the services provided by the private attorney.

25  In contingent fee matters, the lodestar figure calculated may

26  include a contingency risk multiplier not greater than 3.

27         (c)  No contract or settlement agreement shall

28  authorize or permit payment, negotiation or collection by a

29  private counsel firm of any attorneys' fee  for work performed

30  on behalf of the state or any agency thereof in a single case

31  in excess of $10,000,000, excluding reimbursement for expenses

 1  but including legal services provided by subcontractors,

 2  unless a specified higher maximum is approved for the

 3  particular case by the Governor for his or her office or

 4  agencies, or by each of the respective Cabinet members for his

 5  or her department. Specific approval for a higher maximum for

 6  a department under the Cabinet shall require approval by the

 7  Attorney General.  Each approval of a higher maximum fee

 8  pursuant to this paragraph shall be subject to the notice,

 9  review, and objection procedures in s. 216.177.
