  1                      A bill to be entitled

  2         An act relating to husband and wife; providing

  3         that a husband and wife are jointly and

  4         severally liable for certain debts and

  5         necessaries; providing an effective date.

  7  Be It Enacted by the Legislature of the State of Florida:

  8

  9         Section 1.  Doctrine of necessaries.--The husband and

10  wife are liable jointly and severally for any debts incurred

11  by either, during the marriage and before either the date a

12  separation agreement is entered into or the date of the filing

13  of a petition for dissolution of marriage, whichever is

14  earlier, unless otherwise specified by an order of the court,

15  for necessary food, clothing, shelter, and medical care for

16  themselves and their dependent children, and for the education

17  and care of their dependent children.

18         Section 2.  This act shall take effect October 1, 1999.

21                          HOUSE SUMMARY

      Provides that the husband and wife are liable jointly and
23    severally for any debts incurred by either, while during
      the marriage and before either the date a separation
