  1                      A bill to be entitled

  2         An act relating to the Beverage Law; amending

  3         s. 561.01, F.S.; redefining the term "discount

  4         in the usual course of business" as it relates

  5         to malt beverage distributors; providing an

  6         effective date.

  8  Be It Enacted by the Legislature of the State of Florida:

  9

10         Section 1.  Subsection (10) of section 561.01, Florida

11  Statutes, is amended to read:

12         561.01  Definitions.--As used in the Beverage Law:

13         (10)  "Discount in the usual course of business" means

14  a cash or spirituous or vinous beverage merchandise discount

15  given pursuant to an agreement made at the time of sale.

16  However, such agreement shall not result in an accrued,

17  accumulated, or retroactive discount.  The same discounts

18  shall be offered to all vendors buying similar quantities.

19  Any discount which is in violation of this section shall be

20  considered an arrangement for financial assistance by gift;

21  however, the Beverage Law or implementing rules may not

22  prohibit licensed distributors of malt beverages from charging

23  different malt beverage prices to different categories of

24  licensees if the categories of licensees are grouped by

25  cities; by counties, whether excluding or including cities

26  with the counties; by branches of a distributor's parent place

27  of business; by license series; by license type; or by general

28  business operation as long as the prices set for a particular

29  category are applied uniformly to all licensees in that

30  category.

31         Section 2.  This act shall take effect July 1, 1999.
