  1                      A bill to be entitled

  2         An act relating to condominiums; amending s.

  3         718.105, F.S.; requiring the filing of a

  4         certificate attesting to the payment of taxes;

  5         amending s. 468.4315, F.S.; providing

  6         rulemaking authority; providing an effective

  7         date.

  9  Be It Enacted by the Legislature of the State of Florida:

10

11         Section 1.  Subsection (5) is added to section 718.105,

12  Florida Statutes, to read:

13         718.105  Recording of declaration.--

14         (5)  When a declaration of condominium is recorded

15  pursuant to this section, a certificate showing that taxes on

16  the property have been paid must be filed with the clerk of

17  the circuit court of county where the property is located.

18         Section 2.  Subsection (2) of section 468.4315, Florida

19  Statutes, is amended to read:

20         468.4315  Regulatory Council of Community Association

21  Managers.--

22         (2)  The council may adopt rules relating to the

23  licensure examination, continuing education requirements,

24  continuing education providers, fees, and professional

25  practice standards to assist the department in carrying out

26  the duties and authorities conferred upon the department by

27  this part.

28         Section 3.  This act shall take effect July 1, 1999.

  1          STATEMENT OF SUBSTANTIAL CHANGES CONTAINED IN
                       COMMITTEE SUBSTITUTE FOR
  2                             SB 1168

  4  The Committee Substitute for SB 1168 contains the following
    substantial differences from the original bill:
  5
    It deletes from the bill the requirement that the certificate
  6  be filed when a condominium changes ownership.

  7  It requires that the certificate be filed with the clerk of
    the circuit court as opposed to with the county tax collector.
  8
    It adds to the bill an amendment to s. 468.4315, F.S., to
  9  provide the Regulatory Council of Community Association
    Managers the authority to adopt rules on continuing education
10  providers.
