1 A bill to be entitled
2 An act relating to public records; providing an
3 exemption from public records requirements for
4 information provided to state attorneys and
5 sheriffs by persons who take minor children
6 when fleeing from domestic violence; providing
7 for future review and repeal; providing
8 findings of public necessity; providing a
9 contingent effective date.

11 Be It Enacted by the Legislature of the State of Florida:

13 Section 1. Information provided to a state attorney or
14 sheriff under paragraph 787.03(6)(b), Florida Statutes, is
15 confidential and is exempt from section 119.07(1), Florida
16 Statutes, and section 24(a), Article I of the State
17 Constitution. This section is subject to the Open Government
18 Sunset Review Act in accordance with section 119.15, Florida
19 Statutes, and shall stand repealed on October 2, 2004, unless
20 reviewed and saved from repeal through reenactment by the
21 Legislature.
22 Section 2. The Legislature finds that exempting
23 information provided to state attorneys and sheriffs under
24 paragraph 787.03(6)(b), Florida Statutes, by persons fleeing
25 from domestic violence or the threat of it is a public
26 necessity. The information is of sensitive, personal nature
27 concerning individuals who are under threat of physical and
28 psychological harm if their whereabouts is revealed.
29 Section 3. This act shall take effect July 1, 1999,
30 but it shall not take effect if Senate Bill or similar
31 legislation requiring certain identifying information to be

1 filed by persons who take minor children when fleeing
2 situations of domestic violence does not become a law.

5 SENATE SUMMARY
6 Exempts information reported to state attorneys and
sheriffs by persons who take minor children with them
7 when fleeing domestic violence from public records
disclosure.
