  2         An act relating to the juvenile justice

  3         continuum; creating s. 985.3065, F.S.;

  4         authorizing a law enforcement agency or school

  5         district to establish a prearrest diversion

  6         program in cooperation with the state attorney;

  7         providing that a child may be required to

  8         surrender his or her driver's license under the

  9         program; authorizing the state attorney to

10         notify the Department of Highway Safety and

11         Motor Vehicles to suspend the driver's license

12         of a child who fails to comply with the

13         requirements of the prearrest diversion

14         program; providing an effective date.

16  Be It Enacted by the Legislature of the State of Florida:

17

18         Section 1.  Section 985.3065, Florida Statutes, is

19  created to read:

20         985.3065  Prearrest diversion programs.--

21         (1)  A law enforcement agency or school district, in

22  cooperation with the state attorney, may establish a prearrest

23  diversion program.

24         (2)  As part of the prearrest diversion program, a

25  child who is alleged to have committed a delinquent act may be

26  required to surrender his or her driver's license, or refrain

27  from applying for a driver's license, for not more than 90

28  days. If the child fails to comply with the requirements of

29  the program, the state attorney may notify the Department of

30  Highway Safety and Motor Vehicles in writing to suspend the

  1  child's driver's license for a period that may not exceed 90

  2  days.

  3         Section 2.  This act shall take effect July 1, 1999.
