1 A bill to be entitled
2 An act relating to workers' compensation;
3 amending s. 440.092, F.S.; specifying special
4 requirements for compensability with respect to
5 officers who are going to or coming from work
6 in law enforcement vehicles; providing an
7 effective date.

9 Be It Enacted by the Legislature of the State of Florida:

11 Section 1. Subsection (2) of section 440.092, Florida
12 Statutes, is amended to read:
13 440.092 Special requirements for compensability;
14 deviation from employment; subsequent intervening accidents.--
15 (2) GOING OR COMING.--An injury suffered while going
16 to or coming from work is not an injury arising out of and in
17 the course of employment whether or not the employer provided
18 transportation if such means of transportation was available
19 for the exclusive personal use by the employee, unless the
20 employee was engaged in a special errand or mission for the
21 employer. Notwithstanding any provision of law to the
22 contrary, a law enforcement officer as defined in s. 943.10(1)
23 who is going to or coming from work in an official law
24 enforcement vehicle shall be deemed to be engaged in a special
25 errand or mission for the officer's employer.
26 Section 2. This act shall take effect July 1, 1999.

4 Deletes correctional officers and correctional probation
officers from the bill's amendments to the "going and coming"
5 rule under the workers' compensation law, which amendments
provide that a law enforcement officer going to or coming from
6 work in an official law enforcement vehicle is considered to
be engaged in a special errand or mission for the employer and
7 is covered under the workers' compensation law.
