2 An act relating to the judiciary; amending ss.
3 35.02, 35.03, 35.042, 35.043, F.S.; adjusting
4 judicial circuits comprising appellate
5 districts; creating ss. 35.044, 35.045, F.S.;
6 establishing two additional appellate
7 districts; providing for the development of a
8 schedule for implementation and identification
9 of needed resources; providing an effective
10 date.

12 Be It Enacted by the Legislature of the State of Florida:
13
14 Section 1. Section 35.02, Florida Statutes, is amended
15 to read:
16 35.02 First Appellate District.--The First Appellate
17 District is composed of the First, Second, Third, Fourth,
18 Eighth, and Fourteenth Judicial Circuits.
19 Section 2. Section 35.03, Florida Statutes, is amended
20 to read:
21 35.03 Second Appellate District.--The Second Appellate
22 District is composed of the Ninth, Sixth, Tenth, and Twelfth,
23 Thirteenth, and Twentieth Judicial Circuits.
24 Section 3. Section 35.042, Florida Statutes, is
25 amended to read:
26 35.042 Fourth Appellate District.--The Fourth
27 Appellate District is composed of the Fifteenth, Eighteenth,
28 Seventeenth, and Nineteenth Judicial Circuits.
29 Section 4. Section 35.043, Florida Statutes, is
30 amended to read:

1 35.043 Fifth Appellate District.--The Fifth Appellate
2 District is composed of the Third, Fourth, Fifth, Seventh,
3 Ninth, and Eighth Eighteenth Judicial Circuits.
4 Section 5. Section 35.044, Florida Statutes, is
5 created to read:
6 35.044 Sixth Appellate District.--The Sixth Appellate
7 District is composed of the Sixth and Thirteenth Judicial
8 Circuits.
9 Section 6. Section 35.045, Florida Statutes, is
10 created to read:
11 35.045 Seventh Appellate District.--The Seventh
12 Appellate District is composed of the Seventeenth and
13 Twentieth Judicial Circuits.
14 Section 7. Section 35.05, Florida Statutes, is amended
15 to read:
16 35.05 Headquarters.--
17 (1) The headquarters of the First Appellate District
18 shall be in the Second Judicial Circuit, Tallahassee, Leon
19 County; of the Second Appellate District in the Ninth Tenth
20 Judicial Circuit, Orlando, Orange Lakeland, Polk County; of
21 the Third Appellate District in the Eleventh Judicial Circuit,
22 Dade County; of the Fourth Appellate District in the Fifteenth
23 Judicial Circuit, Palm Beach County; and the Fifth Appellate
24 District in the Fourth Seventh Judicial Circuit, Jacksonville,
25 Duval Daytona Beach, Volusia County; the Sixth Appellate
26 District in the Thirteenth Judicial Circuit, Tampa,
27 Hillsborough County; and the Seventh Appellate District in the
28 Seventeenth Judicial Circuit, Broward County.
29 (2) The Second District Court of Appeal may designate
30 other locations within its district as branch headquarters for
31 the conduct of the business of the court in special or regular

1 term and as the official headquarters of its officers or
2 employees pursuant to s. 112.061.
3 Section 8. The Supreme Court of Florida shall
4 establish a schedule for implementing the Sixth and Seventh
5 Appellate Districts by July 1, 2004, in accordance with the
6 provisions of this act. Such schedule must address the
7 acquisition of facilities and equipment, the redistribution of
8 judicial and support resources, and the acquisition of
9 additional judicial and support resources where additional
10 resources are determined to be needed based on work load
11 assessment methods in use by the Court at the time such
12 resources are to be requested from the Legislature.
13 Section 9. This act shall take effect July 1, 1999,
14 except that sections 1 through 7 shall take effect July 1,
15 2004.
