1 A bill to be entitled
2 An act relating to municipal revenues;
3 authorizing the governing body of certain
4 municipalities that have been declared to be in
5 financial emergency to impose a surcharge on
6 parking fees at facilities within their
7 municipalities; providing for future
8 legislative review; providing an effective date
9 and an expiration date.

11 Be It Enacted by the Legislature of the State of Florida:

13 Section 1. (1) The governing body of any municipality
14 that has a population of 300,000 or more and that has within
15 the two previous fiscal years been declared pursuant to
16 section 218.503, Florida Statutes, to be in a state of
17 financial emergency may, by ordinance adopted by a majority of
18 its membership, impose a surcharge of up to 20 percent on the
19 consideration for the sale, lease, or rental of space at each
20 parking facility within the municipality which is open for use
21 by the public. The surcharge shall be collected from the
22 operator of the vehicle at the time he or she pays the
23 consideration for the use of the parking facility.
24 (2) This section expires July 1, 2009, and must be
25 reviewed by the Legislature before that date.
26 Section 2. This act shall take effect July 1, 1999.

2 SENATE SUMMARY
3 Authorizes the governing body of any municipality of
300,000 or more population which has been declared to be
4 in a state of financial emergency to adopt, by a majority
of its membership, an ordinance imposing a surcharge of
5 up to 20 percent on fees for parking at facilities open
to the public within the municipality. The authority
6 expires after 10 years and must be reviewed by the
Legislature before expiration.
