  2         An act relating to trust funds; re-creating the

  3         Education and General Student and Other Fees

  4         Trust Fund within the Department of Education

  5         without modification and placing it on the

  6         standard review cycle; carrying forward current

  7         balances and continuing current sources and

  8         uses thereof; providing an effective date.

  9

10         WHEREAS, the Legislature wishes to extend the life of

11  the Education and General Student and Other Fees Trust Fund

12  within the Department of Education, which is otherwise

13  scheduled to be terminated pursuant to constitutional mandate,

14  and

15         WHEREAS, the Legislature has reviewed the trust fund

16  before its scheduled termination date and has found that it

17  continues to meet an important public purpose, and

18         WHEREAS, the Legislature has found that existing public

19  policy concerning the trust fund sets adequate parameters for

20  its use, NOW, THEREFORE,

22  Be It Enacted by the Legislature of the State of Florida:

23

24         Section 1.  (1)  The Education and General Student and

25  Other Fees Trust Fund within the Department of Education,

26  FLAIR number 49-2-164, which was created by section 240.209,

27  Florida Statutes, and which is to be terminated pursuant to

28  Section 19(f), Article III of the State Constitution on July

29  1, 2003, is re-created for the period of July 1, 2003, to

30  November 4, 2004.

  1         (2)  All current balances of the trust fund are carried

  2  forward, and all current sources and uses of the trust fund

  3  are continued.

  4         Section 2.  This act shall take effect July 1, 2003.
