  1                      A bill to be entitled

  2         An act relating to trust funds; re-creating the

  3         Excellent Teaching Program Trust Fund within

  4         the Department of Education without

  5         modification and placing it on the standard

  6         review cycle; carrying forward current balances

  7         and continuing current sources and uses

  8         thereof; repealing s. 236.08107(2), F.S.;

  9         abrogating provisions relating to the

10         termination of the trust fund, to conform;

11         providing an effective date.

13         WHEREAS, the Legislature wishes to extend the life of

14  the Excellent Teaching Program Trust Fund within the

15  Department of Education, which is otherwise scheduled to be

16  terminated pursuant to constitutional mandate, and

17         WHEREAS, the Legislature has reviewed the trust fund

18  before its scheduled termination date and has found that it

19  continues to meet an important public purpose, and

20         WHEREAS, the Legislature has found that existing public

21  policy concerning the trust fund sets adequate parameters for

22  its use, NOW, THEREFORE,

24  Be It Enacted by the Legislature of the State of Florida:

25

26         Section 1.  (1)  The Excellent Teaching Program Trust

27  Fund within the Department of Education, FLAIR number

28  48-2-206, which was created by chapter 98-210, Laws of

29  Florida, and assigned to section 236.08107, Florida Statutes,

30  and which is to be terminated pursuant to Section 19(f),

31  Article III of the State Constitution on July 1, 2002, unless

  1  terminated sooner by law, is hereby terminated on November 4,

  2  2000, and re-created.

  3         (2)  All current balances of the trust fund are carried

  4  forward, and all current sources and uses of the trust fund

  5  are continued.

  6         Section 2.  Subsection (2) of section 236.08107,

  7  Florida Statutes, 1998 Supplement, is repealed.

  8         Section 3.  This act shall take effect November 4,

  9  2000.
