2 An act relating to college tuition fees;
3 amending s. 110.1099, F.S.; providing
4 conditions under which a state employee may
5 participate in a work-related tuition waiver
6 course; amending s. 240.1201, F.S.; allowing
7 certain retired military personnel and their
8 dependents to be classified as residents for
9 tuition purposes; providing an effective date.

11 Be It Enacted by the Legislature of the State of Florida:

13 Section 1. Subsection (1) of section 110.1099, Florida
14 Statutes, 1998 Supplement, is amended to read:
15 110.1099 Education and training opportunities for
16 state employees.--
17 (1) Education and training are an integral component
18 in improving the delivery of services to the public.
19 Recognizing that the application of productivity-enhancing
20 technology and practice demand continuous educational and
21 training opportunities, state employees may be authorized to
22 receive fundable tuition waivers on a space-available basis or
23 vouchers to attend work-related courses at public
24 universities. Student credit hours generated by state employee
25 fee waivers shall be fundable credit hours. A state employee
26 who attempts to register for a work-related tuition waiver
27 course must be allowed to take the course even when the course
28 is classified as closed if the professor authorizes an
29 override for the employee to participate in the course.

1 Section 2. Paragraph (l) is added to subsection (10)
2 of section 240.1201, Florida Statutes, 1998 Supplement, to
3 read:
4 240.1201 Determination of resident status for tuition
5 purposes.--Students shall be classified as residents or
6 nonresidents for the purpose of assessing tuition fees in
7 public community colleges and universities.
8 (10) The following persons shall be classified as
9 residents for tuition purposes:
10 (l) Any person residing in this state who is a retired
11 member of the Armed Forces of the United States or is the
12 spouse or dependent child of such person but who has
13 maintained his or her residence in this state for less than 1
14 year.
15 Section 3. This act shall take effect upon becoming a
16 law.

19 SENATE SUMMARY
20 Authorizes state employees to participate in work-related
tuition waiver courses under special conditions. Allows
21 retired military personnel, their spouses, and their
dependent children to be classified as residents for
22 college tuition purposes without waiting for 12 months.
