11  Senator Webster moved the following amendment:

13         Senate Amendment (with title amendment) 

14         On page 49, between lines 18 and 19,

15

16  insert:

17         Section 35.  Subsection (11) of section 320.8249,

18  Florida Statutes, is repealed.

19         Section 36.  Subsection (2) of section 320.8325,

20  Florida Statutes, is amended to read:

21         320.8325  Mobile homes and park trailers; tie-down

22  requirements; minimum installation standards; injunctions;

23  penalty.--

24         (2)  The department shall promulgate rules and

25  regulations setting forth uniform minimum standards for the

26  manufacture or installation of anchors, tie-downs,

27  over-the-roof ties, or other reliable methods of securing

28  mobile homes or park trailers when over-the-roof ties are not

29  suitable due to factors such as unreasonable cost, design of

30  the mobile home or park trailer, or potential damage to the

31  mobile home or park trailer. No entity, other than the

 1  department, has authority to amend these uniform standards.

 2  Such devices required under this section, when properly

 3  installed, shall cause the mobile home or park trailer to

 4  resist wind overturning and sliding.  In promulgating such

 5  rules and regulations, the department may make such

 6  discriminations regarding mobile home or park trailer tie-down

 7  requirements as are reasonable when factors such as age,

 8  location, and practicality of tying down a mobile home or park

 9  trailer are considered.

19         repealing s. 320.8249(11), F.S.; which provides

20         for an exemption from installer licensing;

21         amending s. 320.8325, F.S.; providing for

22         uniform standards;
