18 Section 48. Section 325.2135, Florida Statutes, 1998
19 Supplement, is amended to read:
20 325.2135 Motor vehicle emissions inspection program;
21 development of specifications; fees; reporting.--
22 (1) The Department of Highway Safety and Motor
23 Vehicles shall hire an independent expert consultant to
24 develop appropriate request-for-proposal specifications and a
25 range of inspection fees for the motor vehicle emissions
26 inspection program based on an annual and a biennial
27 inspection program for vehicles 4 model years old and older,
28 using the basic test for hydrocarbon emissions and carbon
29 monoxide emissions and other mobile source testing for nitrous
30 oxides or other pollutants, and no later than January 1, 1999,
31 to report to the President of the Senate and the Speaker of

1 the House of Representatives setting forth the relevant facts
2 and the department's recommendations. Notwithstanding the
3 provisions of chapter 325, the department and the Governor and
4 Cabinet, acting as head of that agency, are prohibited from
5 entering into any contract or extension of a contract for any
6 form of motor vehicles emissions testing without legislative
7 approval through the enactment of specific legislation
8 directing the department to implement an inspection program
9 and establishing a fee for the program.
10 (2) If no specific legislation is passed during the
11 1999 legislative session to direct the department to implement
12 a motor vehicle inspection program, the department may issue a
13 request for proposal and The department may extend the current
14 emissions inspection program contracts for a period of time
15 sufficient to implement new contracts resulting from
16 competitive proposals, and shall enter into and implement one
17 or more contracts by June 30, 2000, for a biennial inspection
18 program for vehicles 4 5 model years and older using the basic
19 test for hydrocarbon emissions and carbon monoxide emissions.
20 The requirements for the program included in the proposals
21 must be based on the requirements under chapter 325 unless
22 those requirements conflict with this section. No contract
23 entered into under this subsection may be for longer than 7 2
24 years. Any contract authorized under this section must contain
25 a provision that, after 4 years, the department reserves the
26 right to cancel the contract upon 6 months' notice to the
27 contractor. Notwithstanding the provisions of s. 325.214, if
28 the fee for motor vehicle inspection proposed by the
29 Department of Highway Safety and Motor Vehicles may not will
30 exceed $19 $10 per inspection., the department may impose the
31 higher fee if such fee is approved through the budget

2 provided to the chairmen of the Senate and House
3 Transportation and Natural Resources Committees at the time it
4 is provided to the Senate Ways and Means and House
5 Appropriations Committees.
6 Section 49. Subsection (2) of section 325.214, Florida
7 Statutes, 1998 Supplement, is amended to read:
8 325.214 Motor vehicle inspection; fees; disposition of
9 fees.--
10 (2) The inspection fee may not exceed $19 shall be
11 $10. Notwithstanding any other provision of law to the
12 contrary, an additional fee of $1 shall be assessed upon the
13 issuance of each dealer certificate, which fee shall be
14 forwarded to the department for deposit into the Highway
15 Safety Operating Trust Fund.
