17 Section 40. Effective July 1, 2000, subsection (8) is
18 added to section 322.08, Florida Statutes, 1998 Supplement, to
19 read:
20 (8) Any person who is employed to transport children
21 under 18 years of age by motor vehicle shall be required, as a
22 condition of employment, to obtain an endorsement on his or
23 her driver license from the Department of Highway Safety and
24 Motor Vehicles. The fee for this endorsement shall be $5. The
25 applicant shall provide a certified copy of a criminal
26 background check conducted by the Florida Department of Law
27 Enforcement when applying for such endorsement. The department
28 shall deny issuance of such endorsement to any applicant who
29 has been convicted or found guilty, regardless of
30 adjudication, of a felony or any other crime involving moral
31 turpitude in any of the courts of this state, or any other

1 state, or of the United States. Upon receipt of conviction or
2 finding of guilt of the crimes as set forth in this
3 subsection, the department shall remove the endorsement from
4 the driver license. The endorsement may not be restored unless
5 and until the court sets aside the conviction at issue, or the
6 driver's civil rights have been restored. The department is
7 authorized to adopt rules to implement this section.
