17 Section 71. (1) SHORT TITLE AND PURPOSE.--
18 (a) This section may be cited as the "Florida Clean
19 Fuel Act."
20 (b) The purposes of this act are to establish the
21 Clean Fuel Florida Advisory Board under the Department of
22 Community Affairs to study the implementation of alternative
23 fuel vehicles and to formulate and provide to the Secretary of
24 Community Affairs recommendations on expanding the use of
25 alternative fuel vehicles in this state and make funding
26 available for implementation.
27 (2) DEFINITIONS.--For purposes of this act:
28 (a) "Alternative fuels" include electricity,
29 biodiesel, natural gas, propane, and any other fuel that may
30 be deemed appropriate in the future by the Department of
31 Community Affairs with guidance from the Clean Fuel Florida

1 Advisory Board.
2 (b) "Alternative fuel vehicles" include on-road and
3 off-road transportation vehicles and light-duty, medium-duty,
4 and heavy-duty vehicles that are powered by an alternative
5 fuel or a combination of alternative fuels.
6 (3) CLEAN FUEL FLORIDA ADVISORY BOARD ESTABLISHED;
7 MEMBERSHIP; DUTIES AND RESPONSIBILITIES.--
8 (a) The Clean Fuel Florida Advisory Board is
9 established within the Department of Community Affairs.
10 (b)1. The advisory board shall consist of the
11 Secretary of Community Affairs, or a designee from that
12 department, the Secretary of Environmental Protection, or a
13 designee from that department, the Secretary of Education, or
14 a designee from that department, the Secretary of
15 Transportation, or a designee from that department, the
16 Commissioner of Agriculture, or a designee from the department
17 of Agriculture and Consumer Services, the Secretary of
18 Management Services, or a designee from that department, and a
19 representative of each of the following, who shall be
20 appointed by the Secretary of Community Affairs within 30 days
21 after the effective date of this act:
22 a. The Florida biodiesel industry.
23 b. The Florida electric utility industry.
24 c. The Florida natural gas industry.
25 d. The Florida propane gas industry.
26 e. An automobile manufacturers' association.
27 f. A Florida Clean Cities Coalition designated by the
28 United States Department of Energy.
29 g. Enterprise Florida, Inc.
30 h. EV Ready Broward.
31 i. The Florida petroleum industry.

6 o. Project for an energy efficient Florida.
7 p. Florida Transportation Builders Association.
8 2. The purpose of the advisory board is to serve as a
9 resource for the department and to provide the Governor, the
10 Legislature, and the Secretary of Community Affairs with
11 private sector and other public agency perspectives on
12 achieving the goal of increasing the use of alternative fuel
13 vehicles in this state.
14 3. Members shall be appointed to serve terms of one
15 year each, with reappointment at the discretion of the
16 Secretary of Community Affairs. Vacancies shall be filled for
17 the remainder of the unexpired term in the same manner as the
18 original appointment.
19 4. The board shall annually select a chairperson.
20 5.a. The board shall meet at least once each quarter
21 or more often at the call of the chairperson or the Secretary
22 of Community Affairs.
23 b. Meetings are exempt from the notice requirements of
24 chapter 120, Florida Statutes, and sufficient notice shall be
25 given to afford interested persons reasonable notice under the
26 circumstances.
27 6. Members of the board are entitled to travel
28 expenses while engaged in the performance of board duties.
29 7. The board shall terminate 5 years after the
30 effective date of this act.
31 (c) The board shall review the performance of the

1 state with reference to alternative fuel vehicle
2 implementation in complying with federal laws and maximizing
3 available federal funding and may:
4 1. Advise the Governor, Legislature, and the Secretary
5 of Community Affairs and make recommendations regarding
6 implementation and use of alternative fuel vehicles in this
7 state.
8 2. Identify potential improvements in this act and the
9 state's alternative fuel policies.
10 3. Request from all state agencies any information the
11 board determines relevant to board duties.
12 4. Regularly report to the Secretary of Community
13 Affairs, the Governor, the President of the Senate, and the
14 Speaker of the House of Representatives regarding the board's
15 findings and recommendations.
16 (d)1. The advisory board shall, within 120 days after
17 its first meeting, make recommendations to the Department of
18 Community Affairs for establishing pilot programs in this
19 state that provide experience and support the best use
20 expansion of the alternative fuel vehicle industry in this
21 state. No funds shall be released for a project unless there
22 is at least a 50 percent private or local match.
23 2. In addition to the pilot programs, the advisory
24 board shall assess federal, state, and local initiatives to
25 identify incentives that encourage successful alternative fuel
26 vehicle programs, obstacles to alternative fuel vehicle use
27 including legislative, regulatory, and economic obstacles, and
28 programs that educate and inform the public about alternative
29 fuel vehicles.
30 3. The advisory board is charged with determining a
31 reasonable, fair, and equitable way to address current motor

1 fuel taxes as they apply to alternative fuels and at what
2 threshold of market penetration.
3 4. Based on its findings, the advisory board shall
4 develop recommendations to the Legislature on future
5 alternative fuel vehicle programs and legislative changes that
6 provide the best use of state and other resources to enhance
7 the alternative fuel vehicle market in this state and maximize
8 the return on that investment in terms of job creation,
9 economic development, and emissions reduction.
10 (e) The advisory board, working with the Department of
11 Community Affairs, shall develop a budget for the department's
12 approval and all expenditures shall be approved by the
13 department. At the conclusion of the first year, the
14 department shall conduct an audit of the board and board
15 programs.
