1 A bill to be entitled
2 An act relating to trust funds; re-creating the
3 Preneed Funeral Contract Consumer Protection
4 Trust Fund within the Department of Banking and
5 Finance without modification; carrying forward
6 current balances and continuing current sources
7 and uses thereof; providing an effective date.

9 WHEREAS, the Legislature wishes to extend the life of
10 the Preneed Funeral Contract Consumer Protection Trust Fund
11 within the Department of Banking and Finance, which is
12 otherwise scheduled to be terminated pursuant to
13 constitutional mandate, and
14 WHEREAS, the Legislature has reviewed the trust fund
15 before its scheduled termination date and has found that it
16 continues to meet an important public purpose, and
17 WHEREAS, the Legislature has found that existing public
18 policy concerning the trust fund sets adequate parameters for
19 its use, NOW, THEREFORE,

21 Be It Enacted by the Legislature of the State of Florida:

23 Section 1. (1) The Preneed Funeral Contract Consumer
24 Protection Trust Fund within the Department of Banking and
25 Finance, FLAIR number 44-2-536, which was created by section
26 497.413, Florida Statutes, and which is to be terminated
27 pursuant to Section 19(f), Article III of the State
28 Constitution on November 4, 2000, is re-created.
29 (2) All current balances of the trust fund are carried
30 forward, and all current sources and uses of the trust fund
31 are continued.
