11  The Committee on Fiscal Policy recommended the following

12  amendment:

14         Senate Amendment (with title amendment) 

15          Delete everything after the enacting clause

17  and insert:

18         Section 1.  Section 235.21955, Florida Statutes, is

19  created to read:

20         235.21955  Lottery Capital Outlay and Debt Service

21  Trust Fund.--

22         (1)(a)  The Lottery Capital Outlay and Debt Service

23  Trust Fund is created, to be administered by the Department of

24  Education. Funds shall be credited to the trust fund from

25  legislative appropriations and interest earnings. The purpose

26  of the trust fund is to maintain and account for lottery funds

27  appropriated for fixed capital outlay and debt service

28  separately from lottery funds appropriated for current

29  operations.

30         (b)  Notwithstanding the provisions of s. 216.301 and

31  pursuant to s. 216.351, any balance in the trust fund at the

 1  end of any fiscal year shall remain in the trust fund and

 2  shall be available for carrying out the purposes of the trust

 3  fund.

 4         (2)  Lottery funds appropriated for fixed capital

 5  outlay and debt service, along with any interest earned

 6  thereon, shall be transferred from the Educational Enhancement

 7  Trust Fund to the Lottery Capital Outlay and Debt Service

 8  Trust Fund.

 9         (3)  Pursuant to the provisions of s. 19(f)(3), Art.

10  III of the State Constitution, the trust fund is not subject

11  to termination under s. 19(f)(2), Art. III of the State

12  Constitution.

13         Section 2.  This act shall take effect upon becoming a

14  law.
