1 A bill to be entitled
2 An act relating to public records; providing an
3 exemption from public records requirements for
4 certain records of domestic violence used in
5 unemployment compensation cases; providing an
6 expiration date; providing a finding of public
7 necessity; providing a contingent effective
8 date.

10 Be It Enacted by the Legislature of the State of Florida:

12 Section 1. All records and evidence of domestic
13 violence experienced by an employee who has applied for
14 unemployment compensation with the Division of Unemployment
15 Compensation in accordance with section 443.101, Florida
16 Statutes, are exempt from the disclosure provisions of section
17 24(a) of Article I of the State Constitution and section
18 119.07(1), Florida Statutes, except to the extent consented to
19 by the employee when disclosure is necessary to protect the
20 employee's safety. This exemption is subject to the Open
21 Government Sunset Review Act in accordance with section
22 119.15, Florida Statutes, and expires on October 2, 2004,
23 unless reviewed and reenacted by the Legislature.
24 Section 2. The Legislature finds that it is a public
25 necessity that the records of domestic violence experienced by
26 an employee who has applied for unemployment compensation be
27 held confidential in order to protect the employee.
28 Furthermore, the Legislature finds that it would be an
29 invasion of privacy for these sensitive domestic violence
30 records to be revealed to the public.

1 Section 3. This act shall take effect on the effective
2 date of SB or similar legislation, relating to
3 unemployment compensation, and shall not take effect if that
4 legislation does not become a law.
