  2         An act relating to trust funds; re-creating the

  3         Minerals Trust Fund within the Department of

  4         Environmental Protection without modification;

  5         carrying forward current balances and

  6         continuing current sources and uses thereof;

  7         repealing s. 2, ch. 94-198, Laws of Florida, as

  8         amended; abrogating provisions relating to the

  9         termination of the trust fund; providing

10         effective dates.

12         WHEREAS, the Legislature wishes to extend the life of

13  the Minerals Trust Fund within the Department of Environmental

14  Protection, which is otherwise scheduled to be terminated

15  pursuant to constitutional mandate, and

16         WHEREAS, the Legislature has reviewed the trust fund

17  before its scheduled termination date and has found that it

18  continues to meet an important public purpose, and

19         WHEREAS, the Legislature has found that existing public

20  policy concerning the trust fund sets adequate parameters for

21  its use, NOW, THEREFORE,

23  Be It Enacted by the Legislature of the State of Florida:

24

25         Section 1.  (1)  The Minerals Trust Fund, FLAIR number

26  37-2-499, which was created within the Department of

27  Environmental Protection and which is to be terminated

28  pursuant to Section 19(f), Article III of the State

29  Constitution on November 4, 2000, is re-created.

  1         (2)  All current balances of the trust fund are carried

  2  forward, and all current sources and uses of the trust fund

  3  are continued.

  4         Section 2.  Effective upon this act becoming a law,

  5  section 2 of chapter 94-198, Laws of Florida, as amended by

  6  section 73 of chapter 96-321, Laws of Florida, is repealed.

  7         Section 3.  Except as otherwise provided herein, this

  8  act shall take effect November 4, 2000.
