  1                      A bill to be entitled

  2         An act relating to campaign financing; amending

  3         s. 106.09, F.S.; increasing penalties for

  4         making certain illegal campaign contributions;

  5         providing an effective date.

  7  Be It Enacted by the Legislature of the State of Florida:

  8

  9         Section 1.  Section 106.09, Florida Statutes, is

10  amended to read:

11         106.09  Cash contributions and contribution by

12  cashier's checks.--

13         (1)  No person shall make or accept a cash contribution

14  or contribution by means of a cashier's check in excess of

15  $100.

16         (2)(a)  Any person who makes or accepts a contribution

17  in an amount of $25,000 or more in violation of this section

18  is guilty of a felony of the third degree, punishable as

19  provided in s. 775.082, s. 775.083, or s. 775.084.

20         (b)  Any person who makes or accepts a contribution in

21  an amount more than $100 but less than $25,000 in violation of

22  this section is guilty of a misdemeanor of the first degree,

23  punishable as provided in s. 775.082 or s. 775.083.

24         Section 2.  This act shall take effect January 1, 2000.

                       COMMITTEE SUBSTITUTE FOR
27                             SB 1412

29  The Committee Substitute increases the criminal penalty from a
    first-degree misdemeanor to a third-degree felony for making
30  or accepting a cash contribution of $25,000 or more.
