11  Senator Latvala moved the following amendment:

13         Senate Amendment 

14         Delete everything after the enacting clause

15

16  and insert:

17         Section 1.  Elimination of sewage treatment facility

18  discharges into coastal waters within Pasco County.--

19         (1)  No new discharges, or increased pollutant loadings

20  from existing sewage treatment facilities into the coastal

21  waters of the state within Pasco County, which include, but

22  are not limited to, Anclote Anchorage, Sandy Bay, Cross Bayou,

23  Millers Bayou, Boggy Bay, Hope Bayou, Lighter Bayou, or

24  Fillman Bayou, or into waters tributary thereto, are permitted

25  except as provided in subsection (3).

26         (2)  All existing sewage treatment facility discharges

27  into the coastal waters of the state within Pasco County or

28  into waters tributary thereto, as described in subsection (1),

29  must be eliminated before July 1, 2004, except as provided in

30  subsection (3).

31         (3)  The Department of Environmental Protection may

 1  grant an exception to subsections (1) or (2) only in the

 2  following circumstances:

 3         (a)  The applicant conclusively demonstrates that no

 4  other practical alternative exists, the discharge will receive

 5  advanced waste treatment as defined in s. 403.086(4), or a

 6  higher level of treatment, and the applicant conclusively

 7  demonstrates that the proposed discharge will not result in a

 8  violation of water quality standards; or

 9         (b)  The applicant's discharge is a limited wet weather

10  surface water discharge serving as a backup to a reuse system

11  pursuant to s. 403.086(7)(a) and will not cause a violation of

12  state water quality standards and is subject to the

13  requirements of department rules.

14         Section 2.  This act shall take effect upon becoming

15  law.
