  1                      A bill to be entitled

  2         An act relating to sewage treatment facility

  3         discharges; prohibiting new discharges or

  4         increased pollutant loadings from existing

  5         sewage treatment facilities into coastal waters

  6         adjacent to Pasco County or waters tributary

  7         thereto; authorizing the Department of

  8         Environmental Protection to grant exceptions

  9         under certain circumstances; providing an

10         effective date.

12  Be It Enacted by the Legislature of the State of Florida:

13

14         Section 1.  New or increased sewage treatment facility

15  discharges into coastal waters adjacent to Pasco County

16  prohibited.--

17         (1)  No new discharges or increased pollutant loadings

18  from existing sewage treatment facilities into the coastal

19  waters of the state adjacent to Pasco County, which include,

20  but are not limited to, Anclote Anchorage, Sandy Bay, Cross

21  Bayou, Millers Bayou, Boggy Bay, Hope Bayou, Lighter Bayou, or

22  Fillman Bayou, or into waters tributary thereto, are permitted

23  except as provided in subsection (2).

24         (2)  The Department of Environmental Protection may

25  grant an exception to subsection (1) only in the following

26  circumstances:

27         (a)  If the applicant conclusively demonstrates that no

28  other practical alternative exists and the discharge will

29  receive advanced waste treatment as defined in section

30  403.086(4), Florida Statutes, or a higher level of treatment;

  1         (b)  If the applicant conclusively demonstrates that

  2  the proposed discharge will not result in violation of state

  3  water quality standards, either by itself or in combination

  4  with other discharges, and will not hinder efforts to restore

  5  the water quality of the coastal waters of the state adjacent

  6  to Pasco County; or

  7         (c)  If the applicant's discharge is an intermittent

  8  surface water discharge occurring during wet weather

  9  conditions, subject to the requirements of department rules.

10         Section 2.  This act shall take effect January 1, 2002.

13                       LEGISLATIVE SUMMARY

      Effective January 1, 2002, prohibits new discharges or
15    increased pollutant loadings from existing sewage
      treatment facilities into the coastal waters adjacent to
16    Pasco County or waters tributary thereto. Authorizes the
      Department of Environmental Protection to grant
17    exceptions under specified circumstances. (See bill for
