  1                      A bill to be entitled

  2         An act relating to lead-acid battery fees;

  3         amending s. 403.7185, F.S.; authorizing the

  4         Department of Environmental Protection to make

  5         grants to provide incentives for recycling

  6         facilities for lead-acid batteries and other

  7         lead containing waste products; providing an

  8         effective date.

10  Be It Enacted by the Legislature of the State of Florida:

11

12         Section 1.  Subsection (4) is added to section

13  403.7185, Florida Statutes, to read:

14         403.7185  Lead-acid battery fees.--

15         (4)  At least 15 percent of the revenues collected

16  annually from the lead-acid battery fees shall be designated

17  by the Department of Environmental Protection as grant moneys

18  to provide funding for contamination assessment and

19  remediation of sites contaminated by the disposal of lead-acid

20  batteries and the components thereof and to provide incentives

21  to assist recycling facilities for lead-acid batteries and

22  other lead-containing solid waste products in providing a

23  convenient opportunity for their safe recycling and proper

24  disposal. The Legislature recognizes a need for providing a

25  capability within the state for responding to the recycling,

26  proper disposal, and remediation of waste products generated

27  by users of lead-containing products within the state.

28  Incentive grants may be made for funding public or private

29  activities that are innovative or necessary to maintain

30  environmental compliance with federal and state regulatory

  1  requirements. This subsection expires July 1, 2004, unless

  2  reenacted by the Legislature.

  3         Section 2.  This act shall take effect July 1, 1999.

  6                          SENATE SUMMARY

  7    Directs the Department of Environmental Protection to
      designate a percentage of lead-acid battery fee revenues
  8    as incentive grants to assist recycling facilities and
      provide funding for contamination assessment and
  9    remediation of contaminated sites.
