1 A bill to be entitled
2 An act relating to child care facilities;
3 amending s. 402.305, F.S.; requiring the
4 Department of Children and Family Services, in
5 conjunction with the Department of Health, to
6 develop standards for child care facilities
7 that serve mildly ill children; providing
8 guidelines for the standards; providing an
9 effective date.

11 Be It Enacted by the Legislature of the State of Florida:

13 Section 1. Subsection (19) is added to section
14 402.305, Florida Statutes, 1998 Supplement, to read:
15 402.305 Licensing standards; child care facilities.--
16 (19) MILDLY ILL CHILDREN, CHILD CARE FACILITIES.--The
17 Department of Children and Family Services, in conjunction
18 with the Department of Health, shall develop minimum standards
19 for child care facilities that exclusively serve children who
20 are mildly ill. The minimum standards must address personnel
21 requirements; staff-to-child ratios; staff training and
22 credentialing; health and safety; physical facility
23 specifications, including, but not limited to, square footage
24 requirements; client eligibility, including, but not limited
25 to, a definition of the term "mildly ill children"; sanitation
26 and safety; admission and recordkeeping procedures; dispensing
27 of medication; and a schedule of activities.
28 Section 2. This act shall take effect July 1, 1999.
