  1                      A bill to be entitled

  2         An act relating to transportation; amending s.

  3         334.044, F.S.; providing for the allocation of

  4         a certain percentage of each project for

  5         roadside beautification by the Department of

  6         Transportation; amending s. 335.0415, F.S.;

  7         modifying the date on which jurisdiction and

  8         responsibility for public roads is determined;

  9         providing an effective date.

11  Be It Enacted by the Legislature of the State of Florida:

13         Section 1.  Subsection (26) of section 334.044, Florida

14  Statutes, 1998 Supplement, is amended to read:

15         334.044  Department; powers and duties.--The department

16  shall have the following general powers and duties:

17         (26)  To provide for the conservation of natural

18  roadside growth and scenery and for the implementation and

19  maintenance of roadside beautification programs. To accomplish

20  this, for fiscal years 1999-2000, 2000-2001, and 2001-2002 no

21  less than one percent, and for subsequent fiscal years no less

22  than one and one-half percent of the amount contracted for

23  construction projects shall be allocated by the department to

24  beautification programs. Except where prohibited by federal

25  law or federal regulation and to the extent practical, a

26  minimum of 50 percent of these funds shall be used to purchase

27  large plant materials with the remaining funds for other plant

28  materials and these materials shall be purchased from

29  Florida-based nurseryman stock on a uniform competitive bid

30  basis. The department will develop grades and standards for

31  landscaping materials purchased through this process. To

  1  accomplish these activities, the department may contract with

  2  nonprofit organizations having the primary purpose of

  3  developing youth employment opportunities.

  4         Section 2.  Subsection (1) of section 335.0415, Florida

  5  Statutes, is amended to read:

  6         335.0415  Public road jurisdiction and transfer

  7  process.--

  8         (1)  The jurisdiction of public roads and the

  9  responsibility for operation and maintenance within the

10  right-of-way of any road within the state, county, and

11  municipal road system shall be that which existed exists on

12  June 10 July 1, 1995.

13         Section 3.  This act shall take effect July 1, 1999.
