  1                      A bill to be entitled

  2         An act relating to the Department of Law

  3         Enforcement; requiring the department to

  4         conduct an annual study and prepare a report

  5         relating to stops by law enforcement officers

  6         for routine traffic violations; providing an

  7         effective date.

  9  Be It Enacted by the Legislature of the State of Florida:

10

11         Section 1.  The Department of Law Enforcement shall

12  annually conduct a study of stops by law enforcement officers

13  for routine traffic violations. The study shall include

14  collection and analysis of appropriate available data,

15  including:

16         (1)  The number of individuals stopped for routine

17  traffic violations.

18         (2)  Identifying characteristics of the individuals

19  stopped, including race, ethnicity, and age.

20         (3)  The alleged traffic infraction that led to the

21  stop.

22         (4)  Whether a search was instituted as a result of the

23  stop, how the search was instituted, and the rationale for the

24  search.

25         (5)  Whether any contraband was discovered in the

26  course of the search and the nature of such contraband.

27         (6)  Whether any warning or citation was issued as a

28  result of the stop.

29         (7)  Whether an arrest was made as a result of the stop

30  or the search.

  1         (8)  The benefit of traffic stops with regard to the

  2  interdiction of drugs and the proceeds of drug trafficking,

  3  including the approximate quantity of drugs and value of drug

  4  proceeds seized annually, as a result of routine traffic

  5  stops.

  6         (9)  Whether any items were seized for forfeiture.

  7         Section 2.  The Department of Law Enforcement shall

  8  annually prepare a report compiling the information specified

  9  in section 1 and shall submit a report to the Governor and

10  each member of the Cabinet, the President of the Senate, the

11  Speaker of the House of Representatives, the Minority Leader

12  of the Senate, and the Minority Leader of the House of

13  Representatives.

14         Section 3.  This act shall take effect upon becoming a

15  law.
