1 A bill to be entitled
2 An act relating to statewide drug control;
3 creating the Office of Drug Control within the
4 Executive Office of the Governor; providing for
5 the office to be headed by a director who is
6 appointed by the Governor and subject to Senate
7 confirmation; providing purpose and duties of
8 the Office of Drug Control; creating the
9 Statewide Drug Policy Advisory Council within
10 the Executive Office of the Governor; providing
11 for membership of the advisory council;
12 providing for terms of office; providing for
13 payment of per diem and travel expenses;
14 providing duties of the advisory council;
15 authorizing the chairperson of the advisory
16 council to appoint work groups; requiring an
17 annual report; providing an effective date.

19 Be It Enacted by the Legislature of the State of Florida:
20
21 Section 1. Office of Drug Control.--
22 (1) The Office of Drug Control is created within the
23 Executive Office of the Governor. The Governor shall appoint a
24 director of the Office of Drug Control, who shall be subject
25 to confirmation by the Senate. The director of the Office of
26 Drug Control shall have the same organizational authority as
27 the director of the Office of Planning and Budgeting within
28 the Executive Office of the Governor.
29 (2) The purpose of the Office of Drug Control is to
30 work in collaboration with the Office of Planning and
31 Budgeting and to:

1 (a) Coordinate drug-control efforts and enlist the
2 assistance of state agencies and private organizations that
3 provide programs and services for preventing substance abuse.
4 (b) Provide information to the public about the
5 problem of substance abuse and the programs and services that
6 are available.
7 (c) Act as the Governor's liaison with state agencies,
8 other state governments, the federal Office of National Drug
9 Control Policy, and other federal agencies on matters that
10 relate to substance abuse and the control of drug trafficking.
11 (d) Work to secure funding and other support for the
12 state's drug-control efforts, including establishing
13 cooperative relationships among state and private agencies.
14 Section 2. Statewide Drug Policy Advisory Council.--
15 (1)(a) The Statewide Drug Policy Advisory Council is
16 created within the Executive Office of the Governor. The
17 director of the Office of Drug Control shall be a nonvoting,
18 ex officio member of the advisory council and shall act as
19 chairperson. The director of the Office of Planning and
20 Budgeting shall be a nonvoting, ex officio member of the
21 advisory council.
22 (b) The following state officials shall be appointed
23 to serve on the advisory council:
24 1. The Attorney General, or his or her designee.
25 2. The executive director of the Department of Law
26 Enforcement, or his or her designee.
27 3. The Secretary of Children and Family Services, or
28 his or her designee.
29 4. The Secretary of Health, or his or her designee.
30 5. The Secretary of Corrections, or his or her
31 designee.

1 6. The Secretary of Juvenile Justice, or his or her
2 designee.
3 7. The Secretary of Community Affairs, or his or her
4 designee.
5 8. The executive director of the Department of Highway
6 Safety and Motor Vehicles, or his or her designee.
7 9. The Adjutant General of the state as the Chief of
8 the Department of Military Affairs, or his or her designee.
9 (c) In addition, the Governor shall appoint 11 members
10 of the public to serve on the advisory council who are
11 knowledgeable about issues relating to drug abuse treatment or
12 the enforcement of drug laws. The members appointed by the
13 Governor must, to the extent possible, equitably represent all
14 geographic areas of the state.
15 (d) The President of the Senate shall appoint a member
16 of the Senate to the advisory council and the Speaker of the
17 House of Representatives shall appoint a member of the House
18 of Representatives to the advisory council.
19 (e) The Chief Justice of the Supreme Court shall
20 appoint a member of the judiciary to the advisory council.
21 (f) Members appointed by the Governor, the President
22 of the Senate, the Speaker of the House of Representatives,
23 and the Chief Justice shall be appointed to terms of 4 years
24 each. However, for the purpose of providing staggered terms,
25 of the Governor's initial appointments, five members shall be
26 appointed to 2-year terms and six members shall be appointed
27 to 4-year terms.
28 (2)(a) Any vacancy on the commission shall be filled
29 in the same manner as the original appointment, and any member
30 appointed to fill a vacancy occurring because of death,
31 resignation, or ineligibility for membership shall serve only

1 for the unexpired term of the member's predecessor. A member
2 is eligible for reappointment.
3 (b) Members of the advisory council shall serve
4 without compensation, but are entitled to reimbursement for
5 per diem and travel expenses as provided in section 112.061,
6 Florida Statutes.
7 (c) The advisory council shall meet at least quarterly
8 or upon the call of the chairperson.
9 (3) The advisory council shall:
10 (a) Conduct a comprehensive analysis of the problem of
11 substance abuse in this state and make recommendations to the
12 Governor and Legislature for developing and implementing the
13 state's drug-control strategy.
14 (b) Review and make recommendations to the Governor
15 and Legislature on a strategy for funding programs for
16 preventing drug abuse and funding other drug-treatment
17 services and programs.
18 (c) Review various substance-abuse-treatment programs,
19 identify the successful programs, and recommend measures that
20 are sufficient to determine program outcomes. The council
21 shall review different methodologies for evaluating programs
22 and determine whether programs within different agencies have
23 common outcomes.
24 (d) Review drug-control strategies, programs, and
25 efforts by other states and the federal government and compile
26 the relevant research.
27 (e) Recommend to the Governor and Legislature research
28 projects that would use research capabilities within the
29 state, including, but not limited to, the resources of the
30 State University System.

1 (f) Recommend to the Governor and Legislature changes
2 in law which would remove barriers to or enhance the
3 implementation of the state's drug-control strategy, including
4 recommendations for substances to be added to or deleted from
5 the schedule of controlled substances.
6 (g) Make recommendations for public information
7 campaigns to be conducted in the state to limit substance
8 abuse, including recommendations for funding the campaigns and
9 the amount of funding necessary.
10 (4)(a) The chairperson of the advisory council shall
11 appoint work groups that include members of state agencies
12 that are not represented on the advisory council and shall
13 solicit input and recommendations from those state agencies.
14 In addition, the director may appoint work groups as necessary
15 from among the members of the advisory council in order to
16 efficiently address specific issues.
17 (b) The advisory council shall submit a report to the
18 Governor, the President of the Senate, and the Speaker of the
19 House of Representatives by January 31 of each year which
20 contains a summary of the work of the council during the
21 preceding year and the recommendations required under
22 subsection (3). Interim reports may be submitted at the
23 discretion of the chairperson of the advisory council.
24 Section 3. This act shall take effect upon becoming a
25 law.

3 Creates the Office of Drug Control within the Executive

confirmation by the Senate. Provides for the Office of
5 Drug Control to coordinate the state's drug-control
efforts and act as a liaison with other states and the
6 Federal Government. Creates the Statewide Drug Policy
Advisory Council within the Executive Office of the
7 Governor. Requires that the advisory council make
recommendations to the Governor and Legislature for
8 implementing the state drug-control efforts. Requires the
advisory council to submit an annual report.
