4 programs for juveniles; providing an effective

7 Be It Enacted by the Legislature of the State of Florida:

9 Section 1. Section 985.300, Florida Statutes, is
10 created to read:
11 985.300 Pre-arrest diversion programs
12 permitted.--Nothing in this chapter or in any other provision
13 of the Florida Statutes shall prohibit law enforcement
14 agencies or local school boards, in cooperation with or with
15 the agreement of the state attorney's office, from initiating
16 and conducting pre-arrest diversion programs designed to
17 divert a juvenile from the need for department custody or
18 judicial handling. As a part of any pre-arrest diversion
19 program, a juvenile who is alleged to have committed a
20 delinquent act may be required, as a part of participation in
21 the program, to surrender his or her driver's license or
22 refrain from applying for a driver's license. Should the
23 juvenile fail to comply with the requirements of the
24 pre-arrest diversion program, the program may forward said
25 driver's license, along with a written statement detailing the
26 violation of the program's requirements to the Department of
27 Highway Safety and Motor Vehicles, which shall, upon receipt
28 thereof, suspend the driver's license, or withhold the
29 juvenile's driving privilege for a period of 90 days.
30 Section 2. This act shall take effect July 1, 1999.
