17 Section 11. Paragraph (a) of subsection (1) of section
18 106.021, Florida Statutes, is amended to read:
19 106.021 Campaign treasurers; deputies; primary and
20 secondary depositories.--
21 (1)(a) Each candidate for nomination or election to
22 office and each political committee shall appoint a campaign
23 treasurer. Each person who seeks to qualify for nomination or
24 election to, or retention in, office shall appoint a campaign
25 treasurer and designate a primary campaign depository prior to
26 qualifying for office. Any person who seeks to qualify for
27 election or nomination to any office by means of the
28 petitioning process shall appoint a treasurer and designate a
29 primary depository on or before the date he or she obtains the
30 petitions. Each candidate shall at the same time he or she
31 designates a campaign depository and appoints a treasurer also

1 designate the office for which he or she is a candidate. If
2 the candidate is running for an office which will be grouped
3 on the ballot with two or more similar offices to be filled at
4 the same election, the candidate must indicate for which group
5 or district office he or she is running. Nothing in this
6 subsection shall prohibit a candidate, at a later date, from
7 changing the designation of the office for which he or she is
8 a candidate. However, if a candidate changes the designated
9 office for which he or she is a candidate, the candidate must
10 notify all contributors in writing of the intent to seek a
11 different office and offer to return pro rata, upon their
12 request, those contributions given in support of the original
13 office sought. If the candidate changing the designated office
14 established a re-election account pursuant to s. 106.141(6),
15 the amount transferred to the re-election account shall be
16 considered a single contribution for purposes of calculating
17 the pro rata distribution. The pro rata portion allocable to
18 the re-election account shall be disposed of in the manner
19 provided in s. 106.141(6)(b)1. This notification shall be
20 given within 15 days after the filing of the change of
21 designation and shall include a standard form developed by the
22 Division of Elections for requesting the return of
23 contributions. The notice requirement shall not apply to any
24 change in a numerical designation resulting solely from
25 redistricting. If, within 30 days after being notified by the
26 candidate of the intent to seek a different office, the
27 contributor notifies the candidate in writing that the
28 contributor wishes his or her contribution to be returned, the
29 candidate shall return the contribution, on a pro rata basis,
30 calculated as of the date the change of designation is filed.

1 30-day period may be used by the candidate for the newly
2 designated office. No person shall accept any contribution or
3 make any expenditure with a view to bringing about his or her
4 nomination, election, or retention in public office, or
5 authorize another to accept such contributions or make such
6 expenditure on the person's behalf, unless such person has
7 appointed a campaign treasurer and designated a primary
8 campaign depository. A candidate for an office voted upon
9 statewide may appoint not more than 15 deputy campaign
10 treasurers, and any other candidate or political committee may
11 appoint not more than 3 deputy campaign treasurers. The names
12 and addresses of the campaign treasurer and deputy campaign
13 treasurers so appointed shall be filed with the officer before
14 whom such candidate is required to qualify or with whom such
15 political committee is required to register pursuant to s.
16 106.03. Each candidate who qualifies with the Department of
17 State for an office not voted upon statewide shall, at the
18 same time, file a copy of the name and address of the campaign
19 treasurer with the supervisor of elections in the county in
20 which the candidate resides.
