3 s. 290.0067, F.S.; providing that the
4 enterprise zone authorized for communities
5 impacted by Lake Apopka land acquisition need
6 not meet certain criteria relating to pervasive
7 poverty, unemployment, and general distress;
8 creating s. 290.0069, F.S.; authorizing the
9 Office of Tourism, Trade, and Economic
10 Development to designate an enterprise zone in
11 Liberty County; providing requirements with
12 respect thereto; authorizing the Office of
13 Tourism, Trade, and Economic Development to
14 designate an enterprise zone in Columbia
15 County; providing requirements with respect
16 thereto; authorizing the Office of Tourism,
17 Trade, and Economic Development to designate an
18 enterprise zone in Suwannee County; providing
19 requirements with respect thereto; providing an
20 extended application period for certain
21 businesses to claim tax incentives; authorizing
22 the Office of Tourism, Trade, and Economic
23 Development to designate an enterprise zone in
24 Gadsden County; providing requirements with
25 respect thereto; authorizing municipalities to
26 designate satellite enterprise zones; providing
27 conditions under which a local government may
28 amend the boundaries of an enterprise zone that
29 contains a brownfield pilot program; providing
30 an effective date.

1 Be It Enacted by the Legislature of the State of Florida:

3 Section 1. Section 290.0067, Florida Statutes, is
4 amended to read:
5 290.0067 Enterprise zone designation for communities
6 impacted by Lake Apopka land acquisition.--Orange County and
7 the municipality of Apopka may jointly apply to the Office of
8 Tourism, Trade, and Economic Development for designation of
9 one enterprise zone encompassing areas suffering adverse
10 economic impacts due to governmental acquisition of Lake
11 Apopka farmlands pursuant to s. 373.461. The application must
12 be submitted by December 31, 1998, and must comply with the
13 requirements of s. 290.0055, except s. 290.0055(3) and (4)(d).
14 Notwithstanding the provisions of s. 290.0065 limiting the
15 total number of enterprise zones designated and the number of
16 enterprise zones within a population category, the Office of
17 Tourism, Trade, and Economic Development may designate one
18 enterprise zone under this section. The Office of Tourism,
19 Trade, and Economic Development shall establish the initial
20 effective date of the enterprise zone designated pursuant to
21 this section based upon when unemployment will occur due to
22 the cessation of farming on lands acquired pursuant to s.
23 373.461. The zone shall terminate 5 years following the
24 established effective date.
25 Section 2. Section 290.0069, Florida Statutes, is
26 created to read:
27 290.0069 Enterprise zone designation for Liberty
28 County.--Liberty County may apply to the Office of Tourism,
29 Trade, and Economic Development for designation of one
30 enterprise zone within an area in Liberty County that is south
31 of the border between Liberty and Gadsden Counties, south of

1 Highway 12, east of Highway 271, and north of Highway 20. The
2 application must be submitted by December 31, 1999, and must
3 comply with the requirements of s. 290.0055. Notwithstanding
4 the provisions of s. 290.0065 limiting the total number of
5 enterprise zones designated and the number of enterprise zones
6 within a population category, the Office of Tourism, Trade,
7 and Economic Development may designate one enterprise zone
8 under this section. The Office of Tourism, Trade, and Economic
9 Development shall establish the initial effective date of the
10 enterprise zone designated pursuant to this section.
11 Section 3. Columbia County, or Columbia County and the
12 municipality of Lake City jointly, may apply to the Office of
13 Tourism, Trade, and Economic Development for designation of
14 one enterprise zone encompassing an area within the county, or
15 within both the county and the municipality. In identifying
16 the area to be nominated for designation as an enterprise
17 zone, Columbia County, or Columbia County and the municipality
18 of Lake City jointly, shall seek to maximize the strategic
19 economic development advantages resulting from the
20 intersection of Interstate 75 and Interstate 10 within
21 Columbia County. The application must be submitted by December
22 31, 1999, and must comply with the requirements of section
23 290.0055, Florida Statutes. Notwithstanding the provisions of
24 section 290.0065, Florida Statutes, limiting the total number
25 of enterprise zones designated and the number of enterprise
26 zones within a population category, the Office of Tourism,
27 Trade, and Economic Development may designate one enterprise
28 zone under this section. The Office of Tourism, Trade, and
29 Economic Development shall establish the initial effective
30 date of the enterprise zone designated pursuant to this
31 section.

1 Section 4. Suwannee County, or Suwannee County and the
2 municipality of Live Oak jointly, may apply to the Office of
3 Tourism, Trade, and Economic Development for designation of
4 one enterprise zone encompassing an area within the county, or
5 within both the county and the municipality. In identifying
6 the area to be nominated for designation as an enterprise
7 zone, Suwannee County, or Suwannee County and the municipality
8 of Live Oak jointly, shall seek to maximize the strategic

21 Section 5. Notwithstanding the time limitations
22 contained in chapters 212 and 220, Florida Statutes, relating
23 to enterprise zone tax incentives, a business that was
24 purchased in February 1992 within an area of Tampa that
25 received a designation as an enterprise zone under section
26 290.0065, Florida Statutes, effective July 1, 1995, and that
27 was eligible to receive enterprise zone tax incentives from
28 July 1, 1995, to July 1, 1998, must submit an application for
29 the tax incentives by December 1, 1999. All other requirements
30 of the enterprise zone program apply to such a business.

1 Section 6. Gadsden County may apply to the Office of
2 Tourism, Trade, and Economic Development for designation of
3 one enterprise zone encompassing an area within the county.
4 The application must be submitted by December 31, 1999, and
5 must comply with the requirements of section 290.0055, Florida
6 Statutes. Notwithstanding the provisions of section 290.0065,
7 Florida Statutes, limiting the total number of enterprise
8 zones designated and the number of enterprise zones within a
9 population category, the Office of Tourism, Trade, and
10 Economic Development may designate one enterprise zone under
11 this section. The Office of Tourism, Trade, and Economic
12 Development shall establish the initial effective date of the
13 enterprise zone designated pursuant to this section.
14 Section 7. Before December 31, 1999, any municipality
15 an area of which has previously received designation as an
16 Enterprise Zone in the population category described in
17 section 290.0065(3)(a)3., Florida Statutes, may create a
18 satellite enterprise zone not exceeding 1.5 square miles in
19 area outside of and, notwithstanding anything contained in
20 section 290.0055(4), Florida Statutes, or any other law, in
21 addition to the previously designated enterprise zone
22 boundaries. The Office of Tourism, Trade, and Economic
23 Development shall amend the boundaries of the areas previously
24 designated by any such municipality as enterprise zones upon
25 receipt of a resolution adopted by the municipality describing
26 the satellite enterprise zone areas, as long as the additional
27 areas are consistent with the categories, criteria, and
28 limitations imposed by section 290.0055, Florida Statutes.
29 However, the requirements imposed by section 290.0055(4)(d),
30 Florida Statutes, do not apply to such satellite enterprise
31 zone areas.

1 Section 8. Notwithstanding any provision of law to the
2 contrary, the governing body of a municipality or a county
3 containing a U.S. Environmental Protection Agency brownfield
4 pilot project that was designated as of May 1, 1997, may apply
5 to the Office of Tourism, Trade, and Economic Development
6 before December 31, 1999, to amend the boundaries of an
7 enterprise zone designated in a municipality or a county
8 containing such brownfield pilot project. The office shall
9 approve the application to amend the boundaries of the
10 enterprise zone if the added area does not increase the
11 overall size of the expanded zone more than its original size
12 or 20 square miles, whichever is larger.
13 Section 9. This act shall take effect upon becoming a
14 law.
