1 A bill to be entitled
2 An act relating to education; creating s.
3 232.042, F.S.; authorizing each district to
4 require each child, prior to enrollment in
5 school, to submit evidence of whether or not he
6 or she has learned to swim; requiring the
7 district school board to provide certain
8 information; providing for review and repeal;
9 providing an effective date.

11 Be It Enacted by the Legislature of the State of Florida:

13 Section 1. Section 232.042, Florida Statutes, is
14 created to read:
15 232.042 Swim lessons; school enrollment
16 requirements.--The school board of each district may establish
17 a policy that requires a child, prior to enrollment in public
18 school, to submit evidence of whether or not he or she has
19 learned to swim. Such a policy shall include provisions for
20 providing information regarding available learn-to-swim
21 programs in the community to the parent or guardian of each
22 child who, upon enrollment, has not learned to swim. No civil
23 liability shall be incurred by any school district based on
24 this section.
25 Section 2. Section 232.042, Florida Statutes, as
26 created by this act, is repealed July 1, 2005, and shall be
27 reviewed prior to that date.
28 Section 3. This act shall take effect upon becoming a
29 law.

1 STATEMENT OF SUBSTANTIAL CHANGES CONTAINED IN
COMMITTEE SUBSTITUTE FOR
2 SB 1552

4 The committee substitute provides that no civil liability will
be incurred by a school district on the basis of the new
5 provisions of the bill and provides for the repeal and review
of the new language. The committee substitute also allows
6 rather than requires the school district to establish a policy
related to determining if a child has learned to swim at the
7 time of enrollment in school.
