2 An act relating to Broward County; providing
3 for the revision of the Charter of the Town of
4 Pembroke Park; providing for extending the
5 corporate limits of the City of Hollywood;
6 providing for extending the corporate limits of
7 the Town of Pembroke Park; providing for
8 annexation of unincorporated areas within
9 Broward County; providing for referenda;
10 providing an effective date.

12 Be It Enacted by the Legislature of the State of Florida:
13
14 Section 1. As of the effective date of this act,
15 Broward County shall have completed a feasibility study of the
16 areas described within this act as South Central Broward
17 County. Broward County shall be responsible for the
18 dissemination of such study to the residents within South
19 Central Broward County.
20 Section 2. The governing body of the Town of Pembroke
21 Park shall schedule an election in accordance with the
22 provisions of law relating to elections currently in force in
23 Broward County on March 7, 2000. The subject of said election
24 shall be a revision of the Charter of the Town of Pembroke
25 Park, effective September 15, 2002, as proposed by the
26 Unincorporated Communities of South Broward, including the
27 presidents or designees of the following civic associations:
28 Carver Ranches/Hyde Park, Twin Lakes, South Broward Commercial
29 Development Corporation, Miami Gardens, Lake Forest, and a
30 designee of the Town of Pembroke Park. The proposed revised
31 Charter of Pembroke Park shall, at a minimum, contain equal

1 representation by single-member districts for the governing
2 body of the Town of Pembroke Park and the change of name of
3 said municipality. The proposed revision shall be submitted to
4 the Town of Pembroke Park no later than November 1, 1999. Only
5 registered voters residing within the boundaries of the Town
6 of Pembroke Park may vote in said election. A mail ballot
7 shall not be used in said election.
8 Section 3. Notwithstanding anything contained in
9 section 2, the revised Charter of Pembroke Park shall be
10 effective only upon an affirmative vote for annexation into
11 the Town of Pembroke Park, as provided in section 4.
12 Section 4. If a majority of voters voting in the
13 referendum provided in section 2 vote in the affirmative, a
14 second election shall be scheduled by the Board of County
15 Commissioners of Broward County in accordance with the
16 provisions of law relating to elections currently in force in
17 Broward County, in conjunction with the general election to be
18 held in November 2000. The subject of said election shall be
19 the annexation into the City of Hollywood or into the Town of
20 Pembroke Park of the unincorporated area within South Central
21 Broward as described in this act. Only registered voters
22 residing in the unincorporated area within South Central
23 Broward, as described in this act, may vote in said election.
24 A mail ballot shall not be used in said election.
25 Section 5. If a majority of voters voting in the
26 unincorporated area within South Central Broward, as described
27 in this act, vote for annexation into the City of Hollywood,
28 the area described in this act shall be deemed a part of the
29 City of Hollywood on September 15, 2002, with the exception of
30 the Town of Pembroke Park.

1 Section 6. If a majority of voters voting in the
2 unincorporated area within South Central Broward, as described
3 in this act, vote for annexation into the Town of Pembroke
4 Park, the area described in this act shall be deemed a part of
5 the Town of Pembroke Park on September 15, 2002, and shall be
6 subject to the charter as provided in section 2.
7 Section 7. South Central Broward as herein described
8 shall include all lands bounded on the south by the boundary
9 of Broward County with Dade County, on the east by the
10 right-of-way forming a part of I-95, on the north by the
11 inclusion of all the rights-of-way of Pembroke Road, and on
12 the west by the inclusion of all of the right-of-way of State
13 Road 7.
14 Section 8. All public roads and the public
15 rights-of-way associated therewith, lying within the limits of
16 the lands subject to annexation herein, as described in
17 section 7, except any county collector roads, are transferred
18 from the jurisdiction of Broward County to the jurisdiction of
19 the annexing municipality.
20 Section 9. Upon annexation into either the City of
21 Hollywood or the Town of Pembroke Park as renamed, the
22 following shall govern the areas described in this act as to
23 South Central Broward:
24 (1) The present land use designation and zoning
25 provided for under the Broward County Comprehensive Plan and
26 Code of Ordinances of Broward County and of Pembroke Park
27 shall remain the law governing the areas provided for in this
28 act. The land use designations and zoning of Broward County
29 and Pembroke Park shall be deemed conforming law.

1 (2) Any change of designated land use or zoning shall
2 be accomplished by enactment of the vote of the majority of
3 the full governing body of the municipality plus one.
4 (3) Notwithstanding subsections (1) and (2), any use
5 that is legally in existence in the areas subject to
6 annexation by this act, at the time such areas become a part
7 of any municipality, may not be prohibited by any municipality
8 for as long as the use shall continue, and may not be
9 voluntarily abandoned.
10 Section 10. Subsequent to the effective date of this
11 act, no annexation by any municipality shall be effective in
12 the area described within this act as South Central Broward.
13 Section 11. Except as otherwise provided herein, this
14 act shall take effect only upon its approval by a majority of
15 those voters of Broward County residing within the boundaries
16 of the Town of Pembroke Park voting in a referendum called by
17 the governing body of the Town of Pembroke Park to be held on
18 March 7, 2000, in accordance with provisions of law relating
19 to elections currently in force, except this section shall
20 take effect upon becoming a law.
