11  Senator Campbell moved the following amendment:

13         Senate Amendment (with title amendment) 

14         On page 25, line 25, through page 26, line 11, delete

15  those lines

17  and insert:

18         Section 14.  Subsection (4) of section 985.404, Florida

19  Statutes, 1998 Supplement, is amended, and subsection (13) is

20  added to that section, to read:

21         985.404  Administering the juvenile justice

22  continuum.--

23         (4)  The department may transfer a child, when

24  necessary to appropriately administer the child's commitment,

25  from one facility or program to another facility or program

26  operated, contracted, subcontracted, or designated by the

27  department, including a postcommitment minimum-risk

28  nonresidential aftercare program. The department shall notify

29  the court that committed the child to the department, in

30  writing, of its transfer of the child from a commitment

31  facility or program to another facility or program of a higher

 1  or lower restrictiveness level.  The court that committed the

 2  child may agree to the transfer or may set a hearing to review

 3  the transfer.  If the court does not respond within 10 days

 4  after receipt of the notice, the transfer of the child shall

 5  be deemed granted.

 6         (13)  The department shall implement procedures to

 7  ensure that educational support activities are provided

 8  throughout the juvenile justice continuum. Such activities may

 9  include, but are not limited to, mentoring, tutoring, group

10  discussions, homework assistance, library support, designated

11  reading times, independent living, personal finance, and other

12  appropriate educational activities.
