16 and insert:
17 Section 5. SHORT TITLE.--This section may be cited as
18 the "Men's Sexual Responsibility Act."
19 (1) Prior to commencing the act of sexual intercourse
20 with a woman a male shall obtain the voluntary consent of the
21 female.
22 (2) Such consent shall be documented by means of
23 obtaining the woman's signature on a consent and disclosure
24 form adopted by rule by the Department of Health certifying
25 that she voluntarily consents to the sexual intercourse with
26 the male.
27 (3) Required elements of the consent for the consent
28 and disclosure form are as follows:
29 (a) The date and location the act of intercourse will
30 take place.
31 (b) A list of the acts to be performed.

1 (c) A statement disclosing that the male has received
2 training in the responsibilities of fatherhood within the past
3 3 months.
4 (d) A statement of any sexually transmitted disease
5 with which either party is infected.
6 (e) If a condom is not to be used, a statement that
7 both parties consent to the act of intercourse without the
8 condom.
9 (f) Consent to any medical testing required to
10 determine the paternity of a child resulting from the act.
11 (g) A statement by both parties that if pregnancy
12 results from the act of intercourse, both will be responsible
13 for the support of a child resulting from the act of
14 intercourse, in amounts to be determined by the Child Support
15 Guidelines of s. 61.30(6), Florida Statutes, or the order of a
16 circuit court.
17 (h) A statement that consent for the act of
18 intercourse may be withdrawn verbally at any time, and that
19 continuation of sexual activity on the part of either party is
20 sexual battery and subjected to the provisions of chapter 794,
21 Florida Statutes.
22 (5) If either of the persons in section (2) above is a
23 minor, the parents of the minor are required to sign the
24 consent and disclosure form with a minor.
25 (6) Any person who violates this section commits a
26 felony of the third degree, punishable as provided in section
27 775.082, section 775.083, or section 775.084, Florida
28 Statutes.
