12  Affairs recommended the following amendment:

14         Senate Amendment (with title amendment) 

15         On page 3, between lines 14 and 15,

16

17  and insert:

18         Section 3.  Subsection (4) of s. 380.23, Florida

19  Statutes, 1998 Supplement, is amended to read:

20         380.23  Federal consistency.--

21         (4)  The department shall by rule adopt procedures for

22  the review of activities, uses and projects expeditious

23  handling of emergency repairs to existing facilities for which

24  consistency review is required pursuant to subsections (1),

25  (2), and (3). Data and information needed for the review of

26  consistency certifications and determinations shall be

27  addressed in the procedural rule. When National Environmental

28  Policy Act documents are prepared, such documents shall be

29  required as necessary data and information for the consistency

30  review of all Outer Continental Shelf plans and other

31  activities, uses and projects deemed significant by the
