1 A bill to be entitled
2 An act creating the Juvenile Welfare Trust
3 Fund; providing its purposes; providing for
4 future repeal and review; providing an
5 effective date.

7 Be It Enacted by the Legislature of the State of Florida:

9 Section 1. (1) There is created in the Department of
10 Juvenile Justice the Juvenile Welfare Trust Fund. The fund
11 shall be credited with proceeds from the operation of
12 canteens, vending machines, hobby shops, activity centers,
13 farming projects, donations to a program, contracted telephone
14 commissions, and other such facilities or programs designated
15 as accruing to the Juvenile Welfare Trust Fund. The purpose of
16 the trust fund shall be for the benefit and welfare of
17 juveniles committed to or detained in facilities operated by
18 the department or by private vendors contracting with the
19 department.
20 (2) Notwithstanding the provisions of section 216.301,
21 Florida Statutes, and pursuant to section 216.351, Florida
22 Statutes, any balance in the trust fund at the end of any
23 fiscal year shall remain in the trust fund at the end of the
24 year and shall be available for carrying out the purposes of
25 the trust fund.
26 (3) Pursuant to the provisions of section 19(f)(2),
27 Article III of the State Constitution, the trust fund shall,
28 unless sooner terminated, be terminated on July 1, 2002.
29 However, before its scheduled termination, the trust fund must
30 be reviewed as provided in section 215.3206(1) and (2),
31 Florida Statutes.
