  2         An act creating the Juvenile Care and

  3         Maintenance Trust Fund; providing its purposes;

  4         providing for future repeal and review;

  5         providing an effective date.

  7  Be It Enacted by the Legislature of the State of Florida:

  8

  9         Section 1.  (1)  There is created in the Department of

10  Juvenile Justice the Juvenile Care and Maintenance Trust Fund.

11  The fund shall be credited with any money or other property

12  received for personal use or benefit of juveniles in the

13  custody of the department. The purpose of the trust fund shall

14  be for the department to act in a fiduciary capacity on behalf

15  of juveniles committed to or detained in facilities operated

16  by the department or by private vendors contracting with the

17  department.

18         (2)  Notwithstanding the provisions of section 216.301,

19  Florida Statutes, and pursuant to section 216.351, Florida

20  Statutes, any balance in the trust fund at the end of any

21  fiscal year shall remain in the trust fund at the end of the

22  year and shall be available for carrying out the purposes of

23  the trust fund.

24         (3)  Pursuant to the provisions of section 19(f)(2),

25  Article III of the State Constitution, the trust fund shall,

26  unless sooner terminated, be terminated on July 1, 2002.

27  However, before its scheduled termination, the trust fund must

28  be reviewed as provided in section 215.3206(1) and (2),

29  Florida Statutes.

30         Section 2.  This act shall take effect upon becoming a

31  law.
