11  The Committee on Utilities & Communications offered the

12  following:

14         Amendment (with title amendment) 

15  Remove from the bill:  Everything after the enacting clause

16

17  and insert in lieu thereof:

18         Section 1.  Subsections (6) and (7) are added to

19  Section 501.616, Florida Statutes, to read:

20         501.616  Unlawful acts and practices.--

21         (6)  It is the intent of the Legislature to protect

22  consumers from unwanted telephone solicitations and afford

23  consumers as much possible information regarding the identity

24  of any commercial telephone seller or salesperson who places a

25  call to that consumer.

26         (7)  It shall be unlawful for any commercial telephone

27  seller or salesperson making telephonic solicitations to:

28         (a)  Take any intentional action to prevent

29  transmission of the telephone solicitor's name or telephone

30  number to the party called when the equipment or service used

31  by the telephone solicitor is capable of creating and

 1  transmitting the telephone solicitor's name or telephone

 2  number; or

 3         (b)  Knowingly provide a false or fictitious telephone

 4  number to the called party.

 5         Section 2.  This act shall take effect October 1, 1999.

10  remove from the title of the bill:  the entire title

12  and insert in lieu thereof:

13                      A bill to be entitled

14         An act relating to telephone solicitation;

15         amending s. 501.616, F.S.; providing

16         legislative intent; prohibiting specified

17         intentional actions by commercial telephone

18         sellers or salespersons; providing an effective

19         date.
