  2         An act relating to Indian River County;

  3         amending chapter 61-2275, Laws of Florida, as

  4         amended; requiring a referendum of the electors

  5         of the county prior to any decision by the

  6         Indian River County Hospital District to sell

  7         Indian River Memorial Hospital; providing an

  8         effective date.

10  Be It Enacted by the Legislature of the State of Florida:

11

12         Section 1.  Subsection (6) is added to section 2.1 of

13  chapter 61-2275, Laws of Florida, as created by chapter

14  84-451, Laws of Florida, to read:

15         Section 2.1

16         (6)  Prior to any decision to sell all or substantially

17  all of the facilities which make up Indian River Memorial

18  Hospital, the district shall cause a referendum to be held at

19  which the electors of Indian River County shall have the

20  opportunity to express their approval or disapproval of the

21  proposed sale. The referendum shall be held in accordance

22  with:

23         (a)  The bond referendum procedure set forth in s.

24  100.201, et seq., Florida Statutes;

25         (b)  The procedure for a mail ballot referendum set

26  forth in s. 101.6101, et seq., Florida Statutes; or

27         (c)  Any other comparable procedure set forth in then

28  existing Florida law.

30  The specific procedure to be utilized shall be determined by

31  the district in the resolution calling for such referendum.

  1  The result of the referendum shall be binding upon the

  2  district. Nothing herein shall prevent the district from

  3  changing minor details of the proposed sale following the

  4  referendum, provided the district determines that such changes

  5  are in the best interest of the residents of Indian River

  6  County.

  7         Section 2.  This act shall take effect upon becoming a

  8  law.
