  1                      A bill to be entitled

  2         An act relating to salary freezes; amending ss.

  3         145.031, 145.051, 145.071, 145.09, 145.10,

  4         145.11, 145.19, and 230.202, F.S.; providing

  5         that the salaries of the members of the board

  6         of county commissioners, clerk of the circuit

  7         court, county comptroller, sheriff, supervisor

  8         of elections, property appraiser, tax

  9         collector, and members of the school board

10         shall not be set by population formula, but

11         shall be as approved by the board of county

12         commissioners; providing that annual

13         adjustments to such salaries shall also be set

14         by the board of county commissioners; providing

15         an effective date.

17  Be It Enacted by the Legislature of the State of Florida:

18

19         Section 1.  Subsection (1) of section 145.031, Florida

20  Statutes, is amended to read:

21         145.031  Board of county commissioners.--

22         (1)  Each member of the board of county commissioners

23  shall receive as salary the amount indicated, based on the

24  population of his or her county until July 1, 1999.  In

25  addition, compensation shall be made for population increments

26  over the minimum for each population group, which shall be

27  determined by multiplying the population in excess of the

28  minimum for the grouping times the group rate. On and after

29  July 1, 1999, each member of the board of county commissioners

30  shall receive as salary the amount in effect on June 30, 1999,

  1  and thereafter shall receive as salary an amount approved by

  2  the board of county commissioners.

15         Section 2.  Subsection (1) of section 145.051, Florida

16  Statutes, is amended to read:

17         145.051  Clerk of circuit court; county comptroller.--

18         (1)  Each clerk of the circuit court and each county

19  comptroller shall receive as salary the amount indicated,

20  based on the population of his or her county until July 1,

21  1999.  In addition, a compensation shall be made for

22  population increments over the minimum for each population

23  group, which shall be determined by multiplying the population

24  in excess of the minimum for the group times the group rate.

25  On and after July 1, 1999, each clerk of the circuit court and

26  each county comptroller shall receive as salary the amount in

27  effect on June 30, 1999, and thereafter shall receive as

28  salary an amount approved by the board of county

29  commissioners.

11         Section 3.  Subsection (1) of section 145.071, Florida

12  Statutes, is amended to read:

13         145.071  Sheriff.--

14         (1)  Each sheriff shall receive as salary the amount

15  indicated, based on the population of his or her county until

16  July 1, 1999.  In addition, a compensation shall be made for

17  population increments over the minimum for each group, which

18  shall be determined by multiplying the population in excess of

19  the minimum for the group times the group rate. On and after

20  July 1, 1999, each sheriff shall receive as salary the amount

21  in effect on June 30, 1999, and thereafter shall receive as

22  salary an amount approved by the board of county

23  commissioners.

  4         Section 4.  Subsection (1) of section 145.09, Florida

  5  Statutes, is amended to read:

  6         145.09  Supervisor of elections.--

  7         (1)  Each supervisor of elections shall receive as

  8  salary the amount indicated, based on the population of his or

  9  her county until July 1, 1999. In addition, a compensation

10  shall be made for population increments over the minimum for

11  each population group, which shall be determined by

12  multiplying the population in excess of the minimum for the

13  group times the group rate. On and after July 1, 1999, each

14  supervisor of elections shall receive as salary the amount in

15  effect on June 30, 1999, and thereafter shall receive as

16  salary an amount approved by the board of county

17  commissioners.

22         Section 6.  Subsection (1) of section 145.11, Florida

23  Statutes, is amended to read:

24         145.11  Tax collector.--

25         (1)  Each tax collector shall receive as salary the

26  amount indicated, based on the population of his or her county

27  until July 1, 1999.  In addition, a compensation shall be made

28  for population increments over the minimum for each population

29  group, which shall be determined by multiplying the population

30  in excess of the minimum for the group times the group rate.

31  On and after July 1, 1999, each tax collector shall receive as

  1  salary the amount in effect on June 30, 1999, and thereafter

15         Section 7.  Subsection (2) of section 145.19, Florida

16  Statutes, is amended to read:

17         145.19  Annual percentage increases based on increase

18  for state career service employees; limitation.--

19         (2)  Each fiscal year, the salaries of all officials

20  listed in this chapter and ss. 230.202 and 230.303 shall be

21  adjusted by the annual factor.  The Department of Management

22  Services shall certify the annual factor and the cumulative

23  annual factors.  The adjusted salary rate shall be the

24  product, rounded to the nearest dollar, of the salary rate

25  granted by the appropriate section of this chapter multiplied

26  first by the initial factor, then by the cumulative annual

27  factor, and finally by the annual factor.  Any special

28  qualification salary received under this chapter shall be

29  added to such adjusted salary rate, which special

30  qualification salary shall be $2,000, but shall not exceed

31  $2,000. On and after July 1, 1999, with respect to the board

  1  of county commissioners, the clerk of the circuit court, the

  2  county comptroller, the sheriff, the supervisor of elections,

  3  the property appraiser, the tax collector, and the members of

  4  the school board, the adjusted salary rate as described in

  5  this section shall not apply.   Any adjustment to the salary

  6  of such constitutional officers and elected officials shall be

  7  as approved by the board of county commissioners.

  8         Section 8.  Subsection (1) of section 230.202, Florida

  9  Statutes, is amended to read:

10         230.202  District school board members; compensation.--

11         (1)  Each member of the district school board shall

12  receive as salary the amount indicated, based on the

13  population of the member's county until July 1, 1999. In

14  addition, compensation shall be made for population increments

15  over the minimum for each population group, which shall be

16  determined by multiplying the population in excess of the

17  minimum for the group times the group rate. Laws which

18  increase the base salary herein provided shall contain

19  provisions on no other subject. On and after July 1, 1999,

20  each member of the district school board shall receive as

21  salary the amount in effect on June 30, 1999, and thereafter

22  shall receive as salary an amount approved by the board of

23  county commissioners.

  4         Section 9.  This act shall take effect July 1, 1999.

  7                          HOUSE SUMMARY

      Provides that the salaries of the members of the board of
  9    county commissioners, clerk of the circuit court, county
      comptroller, sheriff, supervisor of elections, property
10    appraiser, tax collector, and members of the school board
      shall be as approved by the board of county
11    commissioners.  Also provides that annual adjustments to
      such salaries shall be as approved by the board of county
12    commissioners.
